Communication from City Council, notifying of its election, under the Pennsylvania Liquor Code, 47 P.S. § 4-461, to extend the timeframe for City Council to render a decision on Council Bill #2020-0779, entitled, “Resolution requesting the approval of an inter-municipal transfer of liquor license, License No.R-12796, from Affolder Enterprises, Inc., c/o Susan Affolder, 8026 Edwood Road, Pittsburgh, PA 15237 to the Applicant, Cabaret LLC, for the premises located at 7928 Frankstown Avenue, Pittsburgh, PA 15221, known as "Cabaret, LLC", pursuant to amended Pennsylvania Liquor Code, § 4-461.”

The Council of the City of Pittsburgh hereby elects, pursuant to the Pennsylvania Liquor Code, 47 P.S. § 4-461(b.3), as follows:
Section 1. § 1 of Bill #2020-0912, a Resolution, stated as follows: “Pittsburgh City Council does hereby elect, pursuant to the Pennsylvania Liquor Code, 47 P.S. § 4-461(b.3), which states as follows: “Failure by the governing body of the municipality to render a decision within forty-five days of the applicant's request for approval shall be deemed an approval of the application in terms as presented unless the governing body has notified the applicant in writing of their election for an extension of time not to exceed sixty days. Failure by the governing body of the municipality to render a decision within the extended time period shall be deemed an approval of the application in terms as presented.” to extend the deadline for approval from October 20, 2020 to Monday, December 21, 2020.”
Section 2. City Council now elects to further extend the deadline for approval from Monday, December 21, 2020 (The 30-day deadline accounting for December 19, 2020 being a weekend), to Tuesday, January 19, 2021 (60 days) from the date of the introduction (October 5, 2020) of Council Bill #2020-0779, entitled, “Resolution requesting the approval of an inter-municipal transfer of liquor license, License No.R-12796, from Affolder Enterprises, Inc., c/o Susan Affolder, 8026 Edwood Road, Pittsburgh, PA 15237 to the Applicant, Cabaret LLC, for the premises located at 7928 Frankstown Avenue, Pittsburgh, PA 15221, known as "Cabaret, LLC", pursuant to amended Pennsylvania Liquor Code, §4-461.” Monday, January 18, 2021 is Rev. Dr. Martin Luther King, Jr. Day, a federal holiday, so under the statutory computation of time for deadlines, the next business day, Tuesday, January 19, 2021, is the legal deadline.
Section 3. Rule VIII, § 2 of the Rules of Council states: “[R]eferral to a committee shall not be necessary in the case of any such bill which may by law be passed finally on the day of its introduction.”
Section 4. The City Clerk is hereby authorized and directed to notify the applicant, Cabaret, LLC, in writing, immediately upon filing of the same.
