Title
Resolution granting to Equitable Gas Company a permanent pipeline easement and a temporary construction easement through designated City of Pittsburgh property bounded by lands within Sheridan Park.  
 
Body
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Directors of the Department of Parks and Recreation and Public Works, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement granting to Equitable Gas Company a thirty foot (30') wide permanent easement and a twenty foot (20') wide temporary construction easement, upon which to lay, maintain, operate, replace with the same or other size pipe, and remove a pipeline of twelve (12") inches in diameter, together with necessary gates, drips, meters, regulators, and other gas line related equipment with their housing above or below ground level on, over and through that certain tract of land situate in the 20th Ward, City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, bounded by lands within Sheridan Park.  Said agreement shall be in the form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh and Sheridan Park as the Solicitor may require.
 
      The easements granted to Equitable Gas Company hereunder are further described on the legal description and survey attached respectively hereto as Exhibit "A-1" and "A-2".
 
Section 2.      The privileges and easements hereby granted shall be subject to the following
terms and conditions as shall be more specifically set forth in the agreement authorized by this
Resolution:
 
a)      Equitable Gas Company shall bear the full cost and expense of the installation, construction, use and maintenance of said easements.
 
b)      Equitable Gas Company shall indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages, whether to property or to person, arising by reason of the construction, installation, maintenance, use or removal of the gas lines.
 
c)      Equitable Gas Company shall cause minimum disruption to the natural environment of the park when installing the water lines.
 
d)      Equitable Gas Company shall restore the easement areas in cooperation with and in accordance with the requirements of the approved plans for this area and to the satisfaction of the Director of the Department of Public Works.  
 
e)      Equitable Gas Company shall pay the City the sum of Eight Hundred Dollars ($800.00), due on the date of the signing of the agreement authorized by this Resolution.
 
 
 
 
 
EXHIBIT A-1:  LEGAL DESCRIPTION
 
ALL that certain tract of ground situate in the City of Pittsburgh, 20th Ward, County of Allegheny and Commonwealth of Pennsylvania being as easement 30 feet in width, the centerline of which being bounded and described as follows to-wit:
 
BEGINNING at a point on the easterly line of Adon Street, a 40 foot street, said point being located along the easterly line of Adon Street N 17 o 18' E, a distance of 69.33 feet from the northerly line of Sherwood Avenue, a 50 foot street; thence through land of the Grantor the following nine (9) course and distances:   1) N 72 o 56' 07" E, a distance of 169.78 feet to a point; thence 2) N 14 o 55' 18" E, a distance of 195.07 feet to a point; thence 3) N 58 o 02' 56" W, a distance of 64.20 feet to a point; thence 4) N 29 o 04' 26" W, a distance of 68.28 feet to a point; thence 5) N 11 o 00' 41" W, a distance of 88.73 feet to a point; thence 6) N 22 o 56' 25" W, a distance of 151.25 feet to a point; thence 7) N 09 o 37' 08" E, a distance of 274.01 feet to a point; thence 8) N 40 o 33' 46" E, a distance of 123.87 feet to a point; thence 9) N 17 o 20' 08" W, a distance of 275.46 feet to a point on the existing gas line.
 
Also, a 20.00 foot wide Temporary Construction Easement to the East of said Permanent Easement as shown on Exhibit A-2 hereto.                        
 
TOTAL DISTANCE:  1,415 feet, more or less.
