Title
Resolution authorizing the City of Pittsburgh to issue a quit claim deed for property in the
4th Ward of the City of Pittsburgh to the Pennsylvania Department of Transportation for required right-of-way widening for State Route 885, Section A03, and State Route 2108, Section A05, on Forbes and Fifth Avenues and the Boulevard of the Allies.  Being parcel 28-J-500 and parts of parcel 11-L-280 on Forbes Avenue and parcels 11-M-174, 180, 190, 191, 192 and 198 on Fifth Avenue.  Also authorizing an aerial easement and a temporary construction easement for part of parcel 11-L-280.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  WHEREAS; Said property is no longer needed by the City of Pittsburgh.
 
      WHEREAS; The Pennsylvania Department of Transportation requires this property for  right-of-way widening for State Route 885, Section A03, and State Route 2108, Section A05, in the Forbes-Fifth Corridor in Oakland.
 
Now, therefore, be it resolved, that the proper officers of the City of Pittsburgh are hereby authorized to execute and deliver a quit claim deed in form approved by the City Solicitor to the Pennsylvania Department of Transportation for the following described properties:
 
A)      PENNDOT Parcel No. 8, State Route 885, Section A03, and State Route 2108, Section       A05, required Right-of-Way of 2,707.61 square feet of land acquisition.

E)      PENNDOT parcel No. 26, part of City parcel 11-L-280, required right-of-way of                   27,222.93 square feet of effective land area based on previous widening of Forbes             Avenue from Ordinance No. 598 effective July 18, 1927.  Total damages offered                   is $500.00 given its steep walled slope, linear nature and the un-developable                   condition lying between the Boulevard of the Allies and the Forbes Avenue right-                  of-ways.
 
F)      PENNDOT parcel No. 29, being City parcel 28-J-500, required right-of-way of                   1,487.28 square feet of effective land area based on previous widening of Forbes                   Avenue from Ordinance No. 598 effective July 18, 1927.  Total damages offered                   is $3,700.00 based on its location beneath the Boulevard of the Allies elevated                   right-of-way.
 
G)      PENNDOT parcel No. 43, part of City parcel 11-L-280, required right-of-way of                   990.29 square feet for acquisition; Aerial easement of 2,422.87 square feet; and                   Temporary Construction Easement of 2,866.29 square feet based on previous                   widening of Forbes Avenue from Ordinance No. 598 effective July 18, 1927.                    Total damages offered is $11,500.00 based on the acquisition, aerial easement and             temporary construction easement required adjacent to the Maurice Street                         intersection with Forbes Avenue.
 
      Pittsburgh City Council Resolution No. 1021 of 1988 authorized a leased parking area on       a portion of City parcel 11-L-280 adjacent to the Maurice Street intersection with Forbes       Avenue and being the same area used for the construction easement of 2,866.29 square       feet within PennDOT Parcel No. 43.  This construction easement will displace parking       required for the zoning approval and parking needs of the adjacent business on parcel
      28-J-191.  PennDOT will honor the relocation of parking as per this committed lease       during       construction.
 
Section 2.  Be it further resolved that the said conveyance shall be subject to the following terms and conditions:
 
      a)    All state and local transfer taxes, if any, shall be paid by the purchaser.
 
      b)    All property closing charges shall be paid by the purchaser.
