Resolution amending Resolution No. 13 of 2021, vacating a portion of Colwell Street and portions of Our Way in the 3rd Ward, 6th Council District of the City of Pittsburgh, by extending the expiration date of the payment from the property owners to the Treasury of the City of Pittsburgh from 605 days to 730 days from the effective date of the resolution, August 1st of 2019.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
COLWELL STREET:
All that certain parcel of ground situates in the Third Ward, City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being a portion of Colwell Street, a sixty-foot public right of way, and being more fully described to wit:
Beginning at a point on the southerly right of way line of Colwell Street, where the same is intersected by the easterly right of way line of Stevenson Street, a sixty-four foot public right of way, at the northwesterly corner of Parcel F in the Lower Hill Redevelopment Project ; thence continuing with a line through Colwell Street for the following five courses and distances: First, North 4 degrees 43 minutes 14 seconds East for a distance of 17.50 feet; Second, by the arc of a circle curving to the right, having a radius of 10.00 feet for an arc distance of 15.71 feet (chord bearing and distance being North 49 degrees 43 minutes 14 seconds East, 14.14 feet); Third, South 85 degrees 16 minutes 46 seconds East for a distance of 284.73 feet; Fourth, by the arc of a circle curving to the right, having a radius of 30.00 feet for an arc distance of 47.66 feet (chord bearing and distance being South 39 degrees 45 minutes 51 seconds East, 42.81 feet); Fifth, South 5 degrees 45 minutes 04 seconds West for a distance of 3.18 feet to a point on the westerly right of way line of Pride Street, a sixty-four foot public right of way, where the same is intersected by the southerly right of way line of Colwell Street, at the northeasterly corner of Parcel F in the Lower Hill Redevelopment Project; thence along the southerly right of way line of Coldwell Street for the following three courses and distances: First, by the arc of a circle curving to the left, having a radius of 12.00 feet for an arc distance of 19.07 feet (chord bearing and distance being North 39 degrees 45 minutes 51 seconds West, 17.12 feet); Second, North 85 degrees 16 minutes 46 seconds West for a distance of 306.67 feet; Third, by the arc of a circle curving to the left, having a radius of 6.00 feet for an arc distance of 9.42 feet (chord bearing and distance being South 49 degrees 43 minutes 18 seconds West, 8.49 feet) to the place of beginning.

All that certain parcel of ground situates in the Third Ward, City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being a portion of Our Way, a twenty-eight-foot public right of way, and being more fully described to wit:
Beginning at a point on the northerly right of way line of Our Way, a twenty-eight foot public right of way, where the same is intersected by the easterly right of way line of Stevenson Street, a sixty-four foot public right of way, at a southwesterly corner of Parcel F in the Lower Hill Redevelopment Project; thence continuing with the northerly right of way line of Our Way by the arc of a circle curving to the left, having a radius of 22.00 feet for an arc distance of 34.56 feet (chord bearing and distance being South 40 degrees 16 minutes 46 seconds East, 31.11 feet); thence by a line through Our Way for the following four courses and distances: First, North 85 degrees 16 minutes 46 seconds West for a distance of 19.59 feet; Second, North 4 degrees 43 minutes 14 seconds East for a distance of 12.78 feet Third, North 85 degrees 16 minutes 46 seconds West for a distance of 2.41 feet; fourth, North 4 degrees 43 minutes 14 seconds East for a distance of 9.22 feet to the place of beginning.
OUR WAY:
All that certain parcel of ground situates in the Third Ward, City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being a portion of Our Way, a twenty-eight-foot public right of way, and being more fully described to wit:
Beginning at a point on the northerly right of way line of Our Way, a twenty-eight foot public right of way, where the same is intersected by the westerly right of way line of Pride Street, a sixty-four foot public right of way, at a southeasterly corner of Parcel F in the Lower Hill Redevelopment Project; thence by a line through Our Way for the following three courses and distances: First, South 5 degrees 45 minutes 04 seconds West for a distance of 15.71 feet; Second, by the arc of a circle curving to the right, having a radius of 4.00 feet for an arc distance of 6.21 feet (chord bearing and distance being South 50 degrees 14 minutes 09 seconds West, 5.61 feet); Third, North 85 degrees 16 minutes 46 seconds West for a distance of 15.71 feet to a point on the northerly right of way line of Our Way; thence continuing with the northerly right of way line of Our Way by the arc of a circle curving to the left, having a radius of 20.00 feet for an arc distance of 31.06 feet (chord bearing and distance being North 50 degrees 14 minutes 09 seconds East, 28.03 feet); to the place of beginning.
Total area being dedicated: 6,959 square feet or 0.1598 acres.
Section 1. Pittsburgh Water and Sewer Authority (PWSA) Water Mapping indicates that there is a 12” waterline in Colwell Street within the area of this vacation. This existing waterline must be relocated northward into the Colwell Street right-of-way. This relocation is identified on the Private Contract Plans filed at PWSA. The Sewer Mapping indicates that there is an 18” sewer main in Colwell Street within the area of this vacation. The existing sewer main in this area to be abandoned in place. The extent of abandonment is identified on the Private Contract Plans filed at PWSA; in the 6th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Colwell Street and Our Way, shall, within six hundred five seven hundred thirty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $144,000.00 use of the City of Pittsburgh.
