NEGATIVE RECOMMENDATION
Title
Resolution vacating portions of Carsell Street and Goebel Street in the 21st Ward, 6th Council District, of the City of Pittsburgh.

Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Carsell Street and Goebel Street in the 21st Ward, 6th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
Whereas, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever abutting or non-abutting, for or by reason of said vacation;therefore.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
1. All that certain street to be vacated, being Carsell Way, situate in the 21st Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northerly right of way line of Carsell Way, 25.00 feet wide, and the westerly right of Fulton Street, 40.00 feet wide, said point being S 12° 29' 29” E a distance of 115.5 feet, more or less, from a point at the intersection of the northerly right of way line of Western Avenue, 55.00 feet wide, and the westerly right of Futlon Street; thence from said point of beginning by the westerly right of way line of Fulton Street S 12° 29' 29” E a distance of 25.00 feet to a point on the southerly right of way line of Carsell Way; thence by the southerly right of way line of Carsell Way S 77° 30' 31” W a distance of 363.29 feet to a point on the easterly right of way line of the West End Bridge, State Route No. 0019, variable width; thence by the easterly right of way line of the West End Bridge the following three (3) courses and distances: in a northerly direction by a curve bearing to the right having a radius of 185.00 feet through an arc distance of 26.34 feet, also having a chord bearing of N 10° 48' 25” E and a chord distance of 26.31 feet; S 75° 06' 52” E a distance of 7.00 feet; in a northerly direction by a curve bearing to the right having a radius of 178.00 feet through an arc distance of 4.59 feet, also having a chord bearing of N 15° 37' 28” E and a chord distance of 4.59 feet, to a point on the northerly right of way line of said Carsell Way; thence by the northerly right of way line of Carsell Way N 77° 30' 31” E a distance of 344.50 feet to a point at the intersection of the northerly right of way line of said Carsell Way and the westerly right of said Fulton Street, at the point of beginning.
Containing an area of 8,937 square feet or 0.205 acre.
2. All that certain street to be vacated, being Goebel Street, situate in the 21st Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northerly right of way line of Goebel Street, 50.00 feet wide, and the westerly right of Fulton Street, 40.00 feet wide, said point being S 12° 29' 29” E a distance of 266.8 feet, more or less, from a point at the intersection of the northerly right of way line of Western Avenue, 55.00 feet wide, and the westerly right of Fulton Street; thence from said point of beginning by the westerly right of way line of Fulton Street S 12° 29' 29” E a distance of 28.15 feet to a point of curvature; thence continuing by same in a southerly direction by a curve bearing to the left having a radius of 225.00 feet through an arc distance of 21.88 feet to a point on the southerly right of way line of Goebel Street; thence by the southerly right of way line of Goebel Street S 77° 30' 31” W a distance of 160.82 feet to a point on the northeasterly right of way line of Ramp N of State Route No. 8046; thence by the northerly right of way line of said Ramp N, N 73° 22' 18” W a distance of 102.75 feet to a point on the northerly right of way line of said Goebel Street; thence by the northerly right of way line of Goebel Street N 77° 30' 31” E a distance of 249.52 feet to a point at the intersection of the northerly right of way line of Goebel Street and the westerly right of said Fulton Street, at the point of beginning.
Containing an area of 10,240 square feet or 0.235 acre.
And also reserving the right of easement of 15” and 18” sewer lines and the existing fire hydrant located therein , in the 21st Ward, 6th Council District of the City of Pittsburgh as described shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Carsell and Goebel Streets as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $4,025.00 use if the City of Pittsburgh.
