Title

Resolution providing for the designation and transfer of certain properties to become permanent public passive open space under the City of Pittsburgh Greenways for Pittsburgh Program. 

 

Body

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The appropriate officials of the City of Pittsburgh are hereby authorized to designate and transfer the following properties in various Wards of theCity of Pittsburgh to the Department of Parks and Recreation to become permanent public passive open space under the City of Pittsburgh Greenways for Pittsburgh Program.  Properties to be transferred are indicated on the attached addendum.

 

Section 2.                     The designation and transfer of these Three Taxing Bodies properties by City Council is contingent upon the transfer and conveyance to the City of Pittsburgh of all right, title and interest, if any, by the County of Allegheny and School District of Pittsburgh through their appropriate action.

 

Section 3.                     A Neighborhood Stewardship Commitment is required within five (5) years to assure the continuation of the applicable neighborhood's support of the Greenway designation.

 

Section 4.                     A City of Pittsburgh Planning Commission recommendation affirming the use of the public property as permanent public passive open space is required upon the Planning Department's receipt of a Neighborhood Stewardship commitment to finalize the permanence of a specific Greenway.

 

Section 5.                     After five years a report on the status of Greenways is to be made to City Council if an interim report has not been filed.

 

Section 6.                     All private property owners adjacent to a designated Greenway found to be encroaching on this City property will be                     subject to providing an appropriate barrier or fence with design approval by the appropriate City of Pittsburgh Department.
