Title

Resolution authorizing the Mayor, the Director of the Department of Public Works, and the Director of Finance, on behalf of the City of Pittsburgh, to execute a Cooperation Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh which will provide to the City certain approval and inspection rights related to the future improvements to Broad Street Plaza, located at 5977 Broad Street (Block 83-P, Lot 249) (the “Plaza”) in the 11th Ward of the City of Pittsburgh to the City of Pittsburgh (Council District 9), and authorizing the Mayor and the Director of Finance, on behalf of the City, to accept conveyance of the Plaza following completion of the improvements to the Plaza and approval of the improvements by the City, at a cost not to exceed $1.00 to the City of Pittsburgh.

 

Body

WHEREAS, the City and Urban Redevelopment Authority of Pittsburgh (“URA”) wish to construct a public plaza in the East Liberty neighborhood of Pittsburgh, to be known as Broad Street Plaza; and

 

WHEREAS, the URA and the City wish to enter into a Cooperation Agreement whereby the URA will complete the construction of the Plaza on a parcel currently owned by the URA, and the URA will provide to the City certain approval rights related to the Plaza’s plans and specifications, as well as provide the City the right to inspect the improvements to the Plaza during and at the end of construction; and

 

WHEREAS, upon completion of the final inspection by the City of the Plaza, and the City’s approval of the improvements, the URA shall convey all of its rights, title and interest in the Plaza to the City, and the City has agreed to accept the conveyance of the same, subject to the City’s rights in the Cooperation Agreement.

 

Now, therefore, be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor, the Director of the Department of Public Works, and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Cooperation Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh (“URA”), in a form approved by the City Solicitor, related to the development and conveyance to the City of Broad Street Plaza (the “Plaza”);

 

Section 2.                     The Mayor and the Director of Finance, on behalf of the City, are hereby authorized to  execute a Deed by and between the Urban Redevelopment Authority of Pittsburgh and the City of Pittsburgh in connection with the sale of Block 83-P, Lot 249, for $1.00, said property being in the 11th Ward of the City of Pittsburgh, following completion of the improvements by the URA and final inspection of the Plaza by the City, and the City’s final approval of the same, as governed by the Cooperation Agreement entered into between the City and URA.

 

Section 3.                     The agreement or agreements and deed are subject to the approval of the City Solicitor as to form.
