Title

Resolution providing for an Agreement or Agreements and/or a Cooperation Agreement or Cooperation Agreements, authorizing the City of Pittsburgh to grant licenses, accept improvements and convey lands along the South Shore of the Allegheny River located between Eleventh Street and the 9th Street Bridge to the Sports & Exhibition Authority of Pittsburgh and Allegheny County (SEA) at a cost of One Dollar ($1.00), for the purpose of developing a public park along the South Shore of the Allegheny River.

 

Body

WHEREAS, the SEA has acquired real property and is presently constructing an expansion of the David L. Lawrence Convention Center on land located in the Second (2nd) Ward of the City of Pittsburgh; and

 

WHEREAS,  the City of Pittsburgh and the SEA desire that additional development occur on the South Shore of the Allegheny River in the vicinity of David L. Lawrence Convention Center; and

 

WHEREAS, the SEA is hereby further designated by the City to develop a public park area along the South Shore of the Allegheny River on land located in the Second (2nd) Ward of the City of Pittsburgh between the 9th Street Bridge and Eleventh Street; and

 

WHEREAS, in order to develop this public park, the conveyance of riverfront parcels of land owned by the City, excluding any riparian rights of the City appurtenant to those and other parcels of land in the project area, to the SEA is determined to be reasonable and necessary and in the public interest; and

 

WHEREAS, following completion of work on this public park, the public park will be transferred by the SEA to the City of Pittsburgh.

 

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.  That the Mayor, the Director of Finance and the Director of General Services, on behalf of the City of Pittsburgh, are hereby authorized and directed to enter into such Agreement or Agreements and/or Cooperation Agreement or Cooperation Agreements, as are deemed to be necessary for the purpose of carrying out the intent of this Resolution, the form of which shall be approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as said City Solicitor may require.  Such Agreement or Agreements may be entered into between the City of Pittsburgh and the SEA, and/or the County of Allegheny, and/or such other entities as may be necessary parties for the development of a public park and other public improvements on the South Shore of the Allegheny River in the City of Pittsburgh in the Second (2nd) Ward of the City of Pittsburgh, between the Eleventh Street and the Ninth Street Bridge, and such Agreement or Agreements may provide for the conveyance of any interest in land owned by the City of Pittsburgh to the SEA, as such land is more fully described on Exhibit A hereto, at a cost of One Dollar ($1.00), for purpose of  developing a public park and other public improvements on that land.

 

SECTION 2. Upon completion of development of the public park, the SEA shall agree to transfer, assign and convey its rights and interest in and to the said public park and public improvements to the City of Pittsburgh, pursuant to such agreements and instruments as are acceptable to the City Solicitor.

 

SECTION 3.   These Resolutions will become effective on the date of signature of the Mayor of the City of Pittsburgh.

River Parcels

 

 

All that certain piece or parcels of land situate in the Second Ward of the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit:

 

On the North by the Allegheny River;

 

On the East by the Westerly line of Eleventh Street, as projected;

 

On the South by the new Fort Duquesne Boulevard until its intersects with the Tenth Street By-Pass, and then bordered by the Tenth Street By-Pass;

 

On the West by the Westerly side of Ninth Street and the Ninth Street Bridge.
