Title
Resolution authorizing the Mayor and the Director of the Department of Parks and Recreation to enter into a license and operating agreement with the University Of Pittsburgh in connection with the University's use of and renovations to Mazeroski Field.
Body
WHEREAS, the University of Pittsburgh ("PITT") has agreed at its expense to make and maintain substantial improvements in excess of $500,000 in consideration of the CITY'S agreement to grant PITT certain rights to use Mazeroski Field and the improvements thereon for its women's collegiate softball team upon the terms, provisions and conditions to be set out in the License and Operating Agreement; and
WHEREAS, the public shall greatly benefit from the improvements made to Mazeroski Field and shall likewise be entitled to play softball on the field and enjoy the said improvements upon obtaining proper permits from the CITY.
Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Mayor and the Director of the Department of Parks and Recreation are hereby authorized to enter into a License and Operating Agreement with PITT for a term of ten years with an option to renew for an additional ten years, upon mutual consent by the City of Pittsburgh and PITT with final approval by City Council pursuant to which PITT will make and maintain substantial improvements to Mazeroski Field in exchange for certain use of the field by its women's softball team as requested yearly via permit. The License Agreement shall include a provision that would allow for the public to have access without a permit to the field when it is not in use by those issued permits by the City of Pittsburgh or PITT. The City will assure year round, unlocked public access during daytime, unpermitted hours. The field may be locked at sundown, but must be unlocked by sunrise. The License and Operating Agreement shall be substantially in the form as attached hereto as Exhibit A. The final License and Operating Agreement shall be in a form approved by the City Solicitor.
Section 2. This Resolution shall become effective upon the signature of the Mayor.
