Title

Resolution releasing certain conditions, covenants and restrictions running with certain parcels of land situate in the 12th Ward and 13th Ward of the City of Pittsburgh.

 

Body

WHEREAS, the Urban Redevelopment Authority of Pittsburgh wishes to allow for the unburdened operations of the Animal Rescue League in the 12th Ward and 13th Ward of the City of Pittsburgh; and

 

WHEREAS, the City of Pittsburgh, as a Grantor in the chain of title to certain parcels of property set forth below, placed conditions, covenants and restrictions prohibiting real estate tax exemption and penalties therefore which run with said parcels of land for a period of fifteen (15) years from their respective dates of conveyance; and

 

WHEREAS, the Council of the City of Pittsburgh believes that the best interest of the City of Pittsburgh will be served by releasing the aforementioned conditions, covenants and restrictions, and desires to give its approval of such releases;

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The City of Pittsburgh, in as much as it was a Grantor in the chain of title to the following parcels of land, with the following former parcel identification numbers and former addresses:

BE IT NOW KNOWN TO ALL, that the City of Pittsburgh, in as much as it was a Grantor in the chain of title who placed the following conditions, covenants and restrictions on any or all of the aforementioned lands, for and in consideration of valuable consideration, the receipt and sufficiency of which is hereby acknowledged and received, does hereby forever release, discharge, revoke and otherwise terminate the following conditions, covenants and restrictions, or their functional equivalents:

 

“The express covenant to run with the land for a period of fifteen (15) years from the time of this transfer by the Grantee(s), (his/her/its/their) heirs, executors, administrators, successors and assigns, that no real estate tax exemption will be applied for or sought for all or any part of the above described real property and/or improvements said improvements as now exist or are later constructed.”

 

AND

 

“The further express covenant to run with the land for a period of fifteen (15) years from the date of this transfer by the Grantee(s), (his/her/its/their) heirs, executors, administrators, successors and assigns, that if a real estate tax exemption is sought for and obtained for all or any part of the above described real property and/or improvements as now exist or are later constructed, the said Grantee(s), (his/her/its/their) heirs, executors, administrators, successors and assigns, during the entire period of said exemption shall pay a sum of money to each of the taxing bodies, that is, the City of Pittsburgh, School District of Pittsburgh and the County of Allegheny, all of the Commonwealth of Pennsylvania, equal to double the amount of real estate taxes which would have been levied by each said taxing body on all or any part of the above described real property and/or improvements, said improvements as now exist or are later constructed, but for said exemption.  Upon failure to pay such amounts to the taxing bodies, in addition to any other remedies available, each taxing body shall have the same rights, actions and/or remedies provided it for the collection of real estate taxes levied by that taxing body.”

Section 2.

 

The aforementioned parcels of land have been consolidated into one parcel of land presently known as Lot & Block 125-L-303.

 

Section 3.

 

The City of Pittsburgh hereby authorized the Director of Finance to cause a certified copy of this resolution to be filed in the Allegheny County Department of Real Estate, formerly known as the Allegheny County Recorder of Deeds.
