Title

Ordinance amending and supplementing the Pittsburgh Code, Title Nine, Zoning Code, Article V, Use Table, Section 911.02 to create the definition of Medical Marijuana Dispensary and Medical Marijuana Growing and Processing uses, and to allow for such uses as special exception in certain zoning districts.

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.  The Pittsburgh Code, Title Nine, Zoning Code, Article V, Use Regulations, is hereby supplemented at Chapter 911, Section 911.02, Use Table, as follows:

Manufacturing and Assembly (General) means a Manufacturing and Assembly use with a gross floor area of 20,000 square feet or more.

Medical Marijuana Growing and Processing means an establishment issued a permit by the Department of Health to grow and process medical marijuana.

Medical Office/Clinic means an establishment providing therapeutic, preventative, corrective, healing and health-building treatment services on an out-patient basis by physicians, dentists and other practitioners. Typical uses include medical and dental offices and clinics and out-patient medical laboratories.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Section 2.  The Pittsburgh Code, Title Nine, Zoning Code, Article V, Use Regulations, is hereby amended at Chapter 911, to include Section 911.04.A.99 and 911.04.A.100, as follows:

 

911.04.A.99    Repealed by Ord. No. 8-2013, adopted Jan. 31, 2013 Medical Marijuana Dispensary

Medical Marijuana Dispensary uses shall be subject to the following standards:

(a)                     Off-street parking, loading, and hours of operation shall be conducted in a manner that does not interfere with any industrial operations other uses in the vicinity.

 

911.04.A.100    Repealed by Ord. No. 8-2013, adopted Jan. 31, 2013 Medical Marijuana Growing and Processing

Medical Marijuana Growing and Processing uses shall be subject to the following standards:

(a)                     All uses shall be conducted within a completely enclosed building and shall create no external visible sign of the operation, such as noise, smoke, vibration, or any other factor; and

(b)                     Off-street parking, loading, and hours of operation shall be conducted in a manner that does not interfere with any industrial operations in the vicinity.
