Title
Resolution accepting the dedication of a portion of Elgin Street at King Avenue in the 11th, Ward, 7th Council District of the City of Pittsburgh.  Authorizing the city of Pittsburgh to accept the dedication of certain property in the 11th Ward for the extension of Elgin Street, a 50 foot right -of-way, from its current terminus approximately 200 feet Northwest of Negley Avenue for an additional distance Northwest of approximately 532 feet to an intersection with King Avenue at no cost to the City of Pittsburgh.
 
Body
WHEREAS, The City of Pittsburgh in the revised King Estate Plan of Subdivision, Plan Book Volume 184, page 6 and 7, had dedicated land 25 feet wide by approximately 532 feet for public use for street purposes and,
 
WHEREAS, the Elgin Plan of Lots, Plan Book Volume 48, page 81, has dedicated land 25 feet wide by 180 feet for part of Elgin Street right-of-way being adjacent to Plan Lots 3, 4 and 5 and,
 
WHEREAS, three property owners of Block and lot parcels 82-F-266, 82-G-41 and 82-6 G-37 have all included a 25 foot wide frontage easement for Elgin Street right-of-way in their deeds and,
 
WHEREAS, this purposed extension of Elgin Street presently contains an existing cobblestone Street used as primary access for the seven single family residence being served and,
 
WHEREAS, Plan Lot No 2, in the Elgin Plan of Lots previously mentioned, has 25 feet dedicated for Elgin St. right-of-way adjacent to its Northern lot line and this 25 feet is not required for the extension to King Avenue because it is an un opened and unused for right-of-way purposes.  This 25 feet wide section is currently used as side yard and is included in their metes and bounds description as recorded for placed parcel 82-F-256 286 recorded in Deed Book Volume 10629 page 110.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  That the Mayor, the Director of the Department of Finance and the Director of the Public Works Department on behalf of the City of Pittsburgh, are hereby authorized to accept land dedicated for public right-of-way purposes to extend Elgin Street, in fee simple, and at no cost to the City of Pittsburgh according to the following five descriptions:
 
1.      ALL THAT LOT or parcel of grounds in the 11th Ward being lot no. 3 in the revised King Estate Pan of subdivision, Plan Book volume 184, pages 6 and 7.  Also designated as parcel 82-F-280 in the Deed Registry Office of Allegheny County.
      Beginning at a point on the North West corner of Elgin Street as dedicated to the City of Pittsburgh by Ordinance No.129, March 28, 1922, said point being North 63° 01' 00" West 198.49 feet from the Northwest corner intersection with North Negley Avenue 65 feet wide; thence continuing North 63° 01'00" West a distance of 533.36 feet to a point on the Easterly line of King Avenue, 50 feet wide; thence along said Easterly line of King Ave South 19° 01' 00" West a distance of 25.24 feet to a point; thence South 63° 01' 00' East a distance of 529.86 feet to a point on the Western terminus of dedicated Elgin Street; thence North 26° 59' 00" East a distance of 25.00 feet to the place of beginning, containing 13,290.0 square feet
 
2.      ALL THAT LOT or parcel of ground in the 11th Ward being dedicated for Elgin Street right-of-way fronting on lots 3, 4 and 5 of the Elgin Plan of lots as recorded in Plan Book Volume 48, Page 81 being described as follows:
 
      Beginning on the Northeast corner of Lot No. 5 in the Elgin Plan of Lots; thence North 26° 36' 45" East a distance of 25.0 feet to a point on the Southerly line of Lot No.3 in the revised King Estate Plan of Subdivision; thence along said lot 3 line North 63' 23' 15" West a distance of 180.0 feet to a point; thence South 26° 36' 45" West a distance of 25.0 feet to a point on the Northwest corner of lot no. 3 in the Elgin Plan of Lots; thence along said Northern lot line of Lot No. 3, 4 and 5 South 63° 23' 15" East a distance of 180.0 feet to the place of beginning, containing 4,500.0 square feet.
 
3.      All that lot or piece of ground in the 11th Ward being dedicated as a 25 foot easement for Elgin Street right-of-way from property designated as 82-F-266 and recorded in Deed Book Volume 4017, page 85 in the Deed Registry of Allegheny County and described as follows:
 
Beginning on what would be the center line of Elgin Street if extended West at a point North 63° 01' West a distance of 291.52 feet from the west line of North Negley Ave, 65 feet wide; thence continuing North 63° 01' West a distance of 130.0 feet to a point on the North East corner of the Elgin Plan of Lots also being the center line of Elgin St, 50' wide; thence South 26° 59' West a distance of 25.0 feet to a point at the Northeast corner of lot No.5 in the Elgin Plan of Lots' thence South 63° 01' East a distance of 130.0 feet and parallel with center line of Elgin Streets to a point on the Western lot line parcel 82-G-41; thence North 26° 59' East a distance of 25.0 feet to a point on the on the center line of Elgin Street at the place of beginning, containing 3,250.00 square feet.
 
4.      All that Lot or piece of ground in the 11th Ward being dedicated as a 25 foot easement for Elgin Street right-of-way from property designated as 82-G-41 and recorded in Deed Book Volume  10364 page 530 in the Deed Registry of Allegheny County and described as follows:
 
Beginning on what would be the center line of Elgin Street if extended West at a point North 63° 01' West a distance of 235.52 feet West of North Negley Avenue, 65 feet wide; thence continuing North 63° 01' West a distance of 56.0 feet to a point on the Northeast corner of parcel 82-F-266; thence South 26° 59' west a distance of 25.0 feet along said parcels Eastern line to a point; thence South 63° 01' East a distance of 56.0 feet and parallel with the center line of Elgin Street to a point on the Western lot line of parcel 82-G-37; thence North 26° 59' East a distance of 25.0 feet to a point on the center line of Elgin Street at the place of beginning, containing 1,400.00 square feet.
 
5.      All that lot or piece of ground in the 11th Ward being dedicated as a 25 foot easement for Elgin Street right-of-way from property designated as 82-G-37 and recorded in Deed Book Volume 7039, page 547 in the Deed Registry of Allegheny County and described as follows:
 
Beginning on what would be the center line of Elgin Street if extended West at a point North 63° 01' West a distance of 200.00 feet West of North Negley Avenue, 65 feet wide; thence continuing North 63° 01' West a distance of 35.52 feet to a point on the Northeast corner of parcel 82-G-41; thence South 26° 59' West a distance of 25.00 feet along said parcels Eastern line to a point; thence South 63° 01' East a distance of 35.52 feet to a point on the Southwest corner of previously dedicated Elgin Street right-of-way; thence North 26° 59' East a distance of 25.0 feet along the Western terminus of accepted Elgin Street to a point at the center line of Elgin St. to the place of beginning, containing 888.0 square feet.
 
 
Section 2.  Be it further resolved that said dedication shall be subject to the following terms and conditions:
 
A.      All processing costs,if any, will be paid by the City of Pittsburgh.
