Title

Ordinance amending and supplementing the Pittsburgh Code; TITLE NINE: ZONING, CHAPTER 922: Development Review Procedures, Section 922.02 Occupancy Permits, subsection 922.02.D Timing of Applications by adding a new subparagraph 4 to set expiration dates for Certificates of Occupancy.

Body

                     WHEREAS, Bill No. 1537 of 2003, an ordinance supplementing the Pittsburgh Code with provisions for Licensing Rental Residential Property, was referred to the Board of Code Review; and

 

                     WHEREAS, following a public meeting of the Board of Code Review on May 12, 2003, the Board of Code Review recommended that City Council reject Bill No. 1537 of 2003 as submitted, but noted “The Board's intent is not to reject the merit of the proposal but to re-define and re-evaluate the ordinance with recommendations to follow after a study is conducted by an ad-hoc committee as selected by the Board of Code Review”; and

 

                     WHEREAS, recommendations have not yet been received from the ad-hoc committee selected by the Board of Code Review, and nearly two years have passed since this statement was written by the Board of Code Review; and

 

                     WHEREAS, during the May 12, 2003 meeting, many Board of Code Review members agreed that it may be more feasible to place occupancy permits on an expirable cycle; Now, Therefore,

 

The Council of the City of Pittsburgh adopts the following ordinance:

 

922.02.D Timing of Application

An application for a Certificate of Occupancy shall be submitted at the following times:

1.    Simultaneously with the application for a building permit pursuant to the provisions of the Building Code;

2.    At the time of a change in use of land or structure;;

3.    Prior to the issuance of any permit for Major Excavation/Grading/Fill or for excavation for or erection of a structure or part thereof.  ;

4. Between 18 months and 6 months before expiration of all existing approved Certificates of Occupancy, which shall expire as follows: City Council District

No.1 - December 31, 2006; No. 2 - December 31, 2007; No. 3-December 31, 2008;

No.4 - December 31, 2009; No. 5 - December 31, 2010; No. 6 - December 31, 2012;

No. 7 - December 31, 2013; No. 8 - December 31, 2014; No. 9 - December 31, 2015.  All approved Certificates of Occupancy revised under the schedule set forth above shall be valid for terms of ten years, subject to revocation pursuant to other provisions of the Pittsburgh Code.
