Resolution granting a vacation of Cassina Way, a 15-foot right-of-way, from North Homewood Avenue and Zenith Way, at no cost to the City, in the 13th Ward, 9th Council District of the City of Pittsburgh.

WHEREAS, the URBAN REDEVELOPMENT AUTHORITY OF PITTSBURGH, has requested this vacation, at no cost to the City, to allow for the construction of a 58-unit affordable housing project.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     All that certain lot or piece of ground situate in 13th Ward, City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being part of a public alley as shown on in the Mellon Brother’s Plan of Homewood Plan of Lots, of record in the Recorder’s Office of Allegheny County, Pennsylvania in Plan Book Volume 3, page 270, more particularly described as follows:

 

Beginning at the westerly corner of the intersection of Cassina Way and Zenith Way; Thence from said Point of Beginning, along the southerly side of said Cassina Way, N 6143’08” W, a distance of 96.90 feet to a point, said point being the southerly corner of the intersection of Cassina Way and North Homewood Avenue; Thence N 2839’22” E, a distance of 15.00 feet to a point, said point being the easterly corner of the intersection of North Homewood Avenue and Cassina Way; Thence along the northerly side of Cassina Way, S 6143’08” E, a distance of 96.90 feet to a point, said point being the northerly corner of the intersection of Cassina Way and Zenith Way; Thence S 2839’22” W, a distance of 15.00 feet to the Point of beginning.

 

Said lot or piece of ground containing an area of 1,453 square feet, or 0.033 acres.

 

Section 2.  This portion of the right-of-way is presently open, The Finance Department in line with Law Department policy for a functioning right-of-way, places a price or charge for the vacation of the 1,453 square feet of functioning right-of-way, based on the average assessed value of the adjacent parcels at $0.68 sq ft, at $990.00.

 

Section 3.  PW Reserves the Right for a Utility Easement(s): The Sewer Mapping (attached) indicates that there is a sanitary manhole within the proposed street vacation. Pittsburgh Water will require an easement centered on the facilities.

 

Section 4. This resolution, however, shall not take effect or be of any force or validity unless URBAN REDEVELOPMENT AUTHORITY, shall, within sixty (60) days after the effective date of this resolution, remit to the Treasurer, City of Pittsburgh, the sum of nine hundred and ninety ($990.00) dollars.

 

Section 5.  The City Treasurer shall transmit notice to the City Clerk and the City Solicitor upon payment as described in Section 4.
