Title
Resolution authorizing the Mayor and the Director of the Department of  Public Works and the Director of the Department of Finance, on behalf of the City of Pittsburgh, to negotiate and enter into agreements with the Port Authority of Allegheny County and/or with Norfolk Southern Corporation and/or with Eastside Limited Partnership II and/or with the Urban Redevelopment Authority of Pittsburgh, in connection with property interests and rights of way necessary for the construction, use, operation and maintenance of a pedestrian bridge across the Martin Luther King Jr. East Busway and the adjacent railroad tracks; the pedestrian bridge will extend from Ellsworth Avenue to the Eastside Retail Shopping Complex in the Shadyside and East Liberty neighborhoods, respectively, of Pittsburgh.
 
Body
WHEREAS, the Urban Redevelopment Authority of Pittsburgh ("URA") has undertaken to perform the construction of a new pedestrian bridge connecting East Liberty and Shadyside, from the Eastside Retail Shopping Complex, across the Martin Luther King Jr. East Busway and the adjacent railroad tracks, to Ellsworth Avenue; and
 
WHEREAS, after construction the bridge will be conveyed to the City by the URA ; and
 
WHEREAS, the proposed pedestrian bridge will extend from the southwestern corner of the parking deck of the Eastside Retail Shopping Complex, across the tracks of the Norfolk Southern Railway Company and across the Martin Luther King Jr. East Busway, a distance of 87 feet, to the northern right of way line of Ellsworth Avenue; the width of the bridge will be 28 feet, with a walking surface varying from 12 to 20 feet in width; and
 
WHEREAS, easement and other property transfer agreements will need to be entered into with the various parties, including aerial easement agreements over the railroad tracks and the busway,  and the acquisition or conveyance of property or of property interests at each end of the bridge; and
 
WHEREAS, the pedestrian bridge project is funded through the Federal Highway Administration Hometown Streets Program and the Federal Surface Transportation Program as well as by local funds; and
 
WHEREAS, the pedestrian bridge project is in the public interest and will be beneficial and advantageous to the City neighborhoods in question and their residents;
      
IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:
 
Section 1
The Mayor and the Director of the Department of Public Works and the Director of the Department of Finance are authorized to negotiate and enter into agreements with the Port Authority of Allegheny County and/or Norfolk Southern Corporation and/or  Eastside Limited Partnership II, and/or the Urban Redevelopment Authority of Pittsburgh  for the acquisition or conveyance of property interests and right of way interests as necessary for the construction, use, operation and maintenance of a pedestrian bridge across the Martin Luther King Jr. East Busway and the adjacent railroad tracks; the bridge will extend from Ellsworth Avenue in Shadyside to the Eastside Retail Shopping Complex in East Liberty.
 
Section 2.    The City will enter into various agreements with the Port Authority of Allegheny County,  Norfolk Southern Corporation, the Urban Redevelopment Authority of Pittsburgh,  and  Eastside Limited Partnership II for the securing or conveying of all surface and aerial easements and other property interests as necessary for the construction, operation, repair and/or maintenance of the pedestrian bridge.  
 
Section 3.  The terms of the agreements shall be in a form satisfactory to the City Solicitor.
