Title

Resolution authorizing the Mayor and the Director, Office of Management and Budget, to enter into an Agreement or Agreements with the POISE Foundation in connection with services for a 2024 Juneteenth celebration, for the sum of One Hundred Twenty-Five Thousand Dollars ($125,000.00) over one year and for the payment of the costs thereof.

 

Body

Whereas, City Council enacted Resolution Number 216 of 2023 (the "2023 Authorizing Resolution"), authorizing an agreement or agreements with POISE Foundation for the purpose of providing financial support to a specified arts organization in connection with the 2023 and 2024 Juneteenth celebrations; and,

 

Whereas, the City entered into an agreement with POISE Foundation in 2023 to carry out the intent of the Authorizing Resolution for the 2023 Juneteenth celebration; and,

 

Whereas, said agreement, signed by all parties, was deemed satisfied and closed pursuant to its terms; and,

 

Whereas, the City determined that it would be unable to execute a subsequent agreement for 2024 in order to complete the intent of the Authorizing Resolution, and notified the City Controller of its determination that any subsequent agreement for this purpose would need to be bid competitively; and,

 

Whereas, the City issued and advertised a request for proposals ("RFP") for a vendor to provide various services in connection with the City's decision to sponsor Juneteenth celebrations; and,

 

Whereas, the City selected from among the proposals submitted, a vendor to enter into agreement with for the aforesaid purposes; and,

 

Whereas, this set of decisions has led to confusion for residents, past vendors and, importantly, City Council; and,

 

Whereas, it was Council's intent, in enacting the 2023 Authorizing Resolution, to see POISE Foundation provided $250,000 in connection with both the 2023 and the 2024 Juneteenth celebrations; and,

 

Whereas, the City, for legitimate reasons, has initiated a different process resulting in the selection of a different vendor for 2024, Council believes that special circumstances exist which warrant the execution of an additional contract and the expenditure of additional funds to fulfill the terms of the 2023 Authorizing Resolution notwithstanding the fact that Council acknowledges the propriety of the actions taken by the Office of Management and Budget; and,

 

Be it therefore resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     Mayor and the Director, Office of Management and Budget are hereby authorized to enter into an Agreement or Agreements with the POISE Foundation in connection with services for a 2024 Juneteenth celebration, for the sum of One Hundred Twenty-Five Thousand Dollars ($125,000.00) over one year and for the payment of the costs thereof.

 

Funds shall be paid from the following accounts:

 

2024:                      $125,000.00 from 0222905500.53901.00

 

Section 2.                     Said Agreement or Agreements shall be approved by the City Solicitor as to form.

 

Section 3.                     The Controller is hereby authorized and directed to encumber the funds for each agreement or contract upon execution of said agreements or contracts. No prior competitive process shall be required for an agreement pursuant to this Resolution.

 

Section 4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.

 

I do hereby certify that the foregoing resolution duly engrossed and certified, was delivered by me to the Mayor for his approval or disapproval and that the Mayor failed to approve or disapprove the same, whereupon it became a law without his approval under the provisions of the Act of Assembly in such case made and provided.
