Title

Resolution terminating the Neighborhood Improvement District in the western neighborhoods of Pittsburgh known as the West End Home Assurance Value (“WE HAV”) program.

Body

WHEREAS, City Council Resolution No 478 of 2002 established a Neighborhood Improvement District (NID) in the western neighborhoods of Pittsburgh, to be known as the West End Home Assurance Value (“WE HAV”) program to be administered by the West Pittsburgh Partnership; and

 

WHEREAS, The WE HAV NID exists under authority of the Pennsylvania Neighborhood Improvement District Act, Title 73, Pennsylvania Statutes sections 831 through 840; and

 

WHEREAS, Title 73, Pennsylvania Statutes section 838 (B) specifies a procedure for terminating the NID; and

 

WHEREAS, the West Pittsburgh Partnership, formerly the West End-Elliott Joint Project, is a Community Development Corporation that was in existence and provided extensive community development services for many years prior to the creation of the WE HAV NID;

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.  City Council finds that the attached “Petition from the residents of the City of Pittsburgh requesting a Public Hearing relative to termination of the WE HAV program, pursuant to Pennsylvania Statutes Title 73, Section 838 of 2001, subsection (B) Request for Termination” contains the approval for termination of the NID by more that 40% of the assessed property owners, in numbers located in the NID.

 

Section 2.  City Council hereby terminates the WE HAV NID established by Resolution No. 478 of 2002.

 

Section 3.  Since the West Pittsburgh Partnership existed prior to creation of the NID, and the WE HAV Board of Commissioners (appointed by City Council and the Mayor) administered the NID, City Council's action in terminating the NID is not intended to have any effect on the continuing existence of the West Pittsburgh Partnership.

 

Section 4.  This Resolution shall be filed with the Secretary of the Commonwealth.

 

 

 

 

 

 

 

Section 5.  Upon receipt of the approval of this Resolution from the Secretary of the Commonwealth, the property of the WE HAV Board of Commissioners, approximately$74,067, shall promptly be delivered to the City of Pittsburgh.  The City of Pittsburgh shall then refund approximately $17.75 to the owners of each property that paid the $20 assessment.

 

Section 6.  City Council respectfully requests that the Mayor consider whether a portion of the unspent Community Development Block Grant funds allocated to the WEHAV NID could be utilized to issue refunds of $2.25 to the owners of each property that paid the $20 assessment.
