Title
An Ordinance amending the Pittsburgh Code of Ordinances, Title Nine, Zoning, Chapter 911, Primary Uses, Sections 911.02, Use Table, and 911.04, Use Standards to include a definition and use standards for Public Information Kiosks, and Public Transit Shelters.
Body
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  Amending the Pittsburgh Code of Ordinances, Title Nine, Zoning, Chapter 911, Primary Uses, Sections 911.02, Use Table, and 911.04, Use Standards to include a definition and use standards for Public Information Kiosks, and Public Transit Shelters as follows:
 
[16.      Advertising Signs on Public Transit Shelters, as follows:
Advertising signs shall only be permitted on public transit shelters located within the public right-of-way, which comply with the provisions of Chapter 419 of Title Four, Article I of the Pittsburgh Code of Ordinances.  Additionally, public information kiosks, installed by, or under the direction of, the City of Pittsburgh, with advertising signs shall also be permitted, whether on private property, public property, or in the public right of way.  [And] Both must meet the following criteria:
 
(a)      Advertising signs shall not be located within any residential Zoning District:]      
 
Amend Chapter 911, Primary Uses, Section 911.02, Use Table by adding the following use and definitions:
 
Public Information Kiosk means a free-standing structure to which advertising and non-advertising signs may be attached.
 
Public Transit Shelters are small, roofed structures, usually having three walls, located near a public right-of-way and designed primarily for the protection and convenience of public transit passengers.
 
Amend Chapter 911, Primary Uses, Section 911.02, Use Table as follows:
 
Public Information Kiosks are permitted in the LNC, UNC, HC, H, UI, NDI, PO, EMI, GT, DR, GPR, and OPR Zoning Districts as a Use by Administrator's Exception; add A.93 to the Standards column.
 
 
Public Transit Shelters are permitted in all zoning districts as a Use by Administrator's Exception; add A.94 to the Standards column.
 
Amend Section 911.04.A Standards That Apply to Uses Listed in the Use Table by adding the following:
 
911.04.A.93 Public Information Kiosks
 
(a)      Public Information Kiosks shall have a maximum vertical dimension of not greater than ten (10) feet and a maximum horizontal dimension of the kiosk body of not greater than six (6) feet;
 
(b)      Public Information Kiosks shall have a maximum of two (2) signs and (1) public information panel or one (1) back-to-back sign that includes one (1) information panel and:
 
(1)      does not exceed twenty-four (24) square feet in face area per sign;
(2)      does not exceed the height of the structure; and
(3)      does not extend more than five (5) inches from the structure and is integral to the design;
 
(c)      Public Information Kiosks must be installed as part of a public information program under the direction of, or approved by, the City of Pittsburgh; and
 
(d)      Public Information Kiosks outside the public right-of-way are required to have a Certificate of Occupancy.
 
911.04.A.94 Public Transit Shelters
 
(a)      Public Transit Shelters in areas zoned GT, DR, UNC, LNC, GI, UI, EMI, NDI, NDO, H, PO, OPR, GPR, and all Planned Development Districts are permitted to have advertising;
 
(b)      Signs shall not exceed twenty-four (24) square feet in display surface area per sign;
 
(c)      There shall be a maximum of two (2) advertising signs or one (1) back to back sign on each shelter;
 
(d)      Sign display area must be integral to the design of the structure and may not extend more than five (5) inches from the face of the structure; and
 
(e)      No advertising display shall exceed the height of the structure.
 
NOTE: I do hereby certify that the foregoing Ordinance duly engrossed and certified, was delivered by me to the Mayor for his approval of disapproval and that the Mayor failed to approve or disapprove the same, whereupon it became law without his approval, under the provisons of the Act of the Assembly in such case made and provided.
