Resolution amending Resolution number 1028 of 1994, entitled “Authorizing and directing the City Controller to create a special trust fund, to be designated as the Workers' Compensation Commutation Trust Fund (WCCTF), Index Code 254938, for the deposit of monies received from the state of Pennsylvania for favorable decisions received in litigation (Supersedeas) and monies received when the City is successful in a lawsuit against a negligent third party (Subrogation). Expenditures from this trust will consist of payments to individuals for settlement of their workers' compensation claim, surveillance, vocational rehabilitation, outplacement and other miscellaneous services related to Workers' Compensation management as approved by the Director of Finance.” in order to allow transfers from the WCCTF to the Workers Compensation VEBA Account.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Resolution number 1028 of 1994, entitled “Authorizing and directing the City Controller to create a special trust fund, to be designated as the Workers' Compensation Commutation Trust Fund (WCCTF), Index Code 254938, for the deposit of monies received from the state of Pennsylvania for favorable decisions received in litigation (Supersedeas) and monies received when the City is successful in a lawsuit against a negligent third party (Subrogation). Expenditures from this trust will consist of payments to individuals for settlement of their workers' compensation claim, surveillance, vocational rehabilitation, outplacement and other miscellaneous services related to Workers' Compensation management as approved by the Director of Finance.” is hereby amended to transfer control of the Trust Fund from the Department of Finance to the Department of Human Resources, and to add a Section 2 as follows:
Section 1. The City Controller is hereby authorized and directed to create a special Trust Fund to be designated as the Workers' Compensation Commutation Trust Fund (WCCTF), [Index Code 254938] JD Edwards job number 1090752000, into which trust there shall be deposited any Supersedeas and Subrogation monies received. The monies deposited in said trust fund shall be used by the Department of [Finance, Employee Compensation Division,] Human Resources to settle workers' compensation claims, surveillance, vocational rehabilitation, outplacement and other miscellaneous services related to Workers' Compensation management as approved by the Director .
Section 2. The City Controller is authorized to transfer funds from the Workers’ Compensation Commutation Trust Fund to the VEBA Workers’ Compensation Account, JD Edwards job number 9993817000, in order to satisfy any required VEBA Workers’ Compensation payments or transfers.
