Title
Resolution that the Council of the City of Pittsburgh approves and the Mayor and the City Solicitor are hereby authorized to enter into an Intergovernmental Cooperation Agreement with the Intergovernmental Cooperation Authority for Cities of the Second Class.
Body
Whereas, the General Assembly of the Commonwealth of Pennsylvania has enacted the Intergovernmental Cooperation Authority Act for Cities of the Second Class (Act of 2004, February 12, P.L. 73, No. 11) (the "Act") which provides for the City and the Intergovernmental Cooperation Authority (the "Authority") to enter into such agreements as are necessary to accomplish the purposes of the Act;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Council of the City of Pittsburgh hereby approves and the Mayor and the City Solicitor are hereby authorized to enter into an Intergovernmental Cooperation Agreement with the Intergovernmental Cooperation Authority for Cities of the Second Class substantially in the form of an agreement attached hereto.
Section 2. Said Agreement shall incorporate the following language which was adopted by City Council:
This Agreement shall exclude the Housing Authority as a "Corporate Entity" under Exhibit C.
Pursuant to execution of this agreement, the Mayor, City Council and the Members of the ICA call upon the State Legislature to amend Act 11 of 2004 to increase the number of ICA Board Members from five (5) to seven (7), ensuring diversity of representation based on race, gender, and age.
It is understood that any financial plan proposed by the City and approved by the Authority will contemplate and be consistent with any financial plan proposed by the Act 47 Coordinator, to their best efforts, in concert with the Act 47 Coordinator, to develop, reconcile and approve a singular unified financial plan for the City which will be properly adopted, supersede any other prior financial plans, and otherwise made effective by such precesses and procedures as may be required by law. Thisi provision shall not be construed to require the Authority to approve any financial plan, in whole or in part, by virtue of its best efforts undertaking hereunder, such approval to remain within its sole discretion.
In the event a singular unified Financial Plan is not approved by the Authority, the Financial Plan shall be presented to a Conference Committee composed of the Mayor, President of Council, Act 47 Coordinator, Oversight Board Chairperson, and the Finance Chair of Council appropriate representatives of the Mayor's Office, City Council, Act 47 Coordinators and the ICA to resolve and submit a singular unified Financial Plan.
