Resolution vacating North Canal Street between Chestnut and Heinz Streets in the 23rd Ward, 1st Council District, of the City of Pittsburgh.

 

Body

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of North Canal in the 23rd Ward, in the 1st Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by ant persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  That vacating North Canal Street between Chestnut Street and Heinz Street.

 

All that certain lot or piece of ground situate in the twenty-third (23rd) Ward of the City of Pittsburgh (formerly the Third and Fourth Ward of the City of Allegheny) Allegheny County, Pennsylvania, bounded and described as follows, to wit;

 

Beginning at a point on the northerly line of North Canal Street, 30 foot wide, at the intersection of the southerly line with Heinz Street, 40 foot wide (formerly known as Sycamore Street) and being common with the northerly right of way line of the Norfolk Southern Railroad; Thence from said point of beginning and by the southerly line of North Canal Street, 30 foot wide, being common with the northerly boundary line of the Norfolk Southern Railroad (No record information available at the county courthouse nor railroad records through the Norfolk Southern Railroad), the following courses and distances: South 40 degrees 52 minutes 35 seconds West, for a distance of 167.26 feet to a point; thence by same South 44 degrees 08 minutes 33 seconds West, for a distance of 152.89 feet to a point; thence by same South 44 degrees 32 minutes 26 seconds West, for a distance 108.60 on the northerly line of Chestnut Street, 60 foot wide, at the intersection of the southerly line of North Canal Street, 30 foot wide and being common with the northerly right of way line of the Norfolk Southern Railroad (as referenced above); thence by the northerly line of Chestnut Street, 60 foot wide, North 42 degrees 35 minutes 32 seconds West, for a distance of 30.00 feet to a point at the southerly corner of Lot No. 89 of the Plan of Town Lots as recorded in the Recorder's Office of Allegheny County in Plan Book Volume 1 Page 81; thence by the northerly line of North Canal Street, 30 foot wide and being the southerly boundary of lands of the Sarah Heinz House the following courses and distances: North 44 degrees 32 minutes 36 seconds East, for a distance of 108.17 feet to a point: thence by same North 44 degrees 08 minutes 33 seconds East, for a distance of 149.99 feet to a point; thence by same North 40 degrees 52 minutes 35 seconds East for a distance of 167.58 feet to a point of the southerly line of aforesaid Heinz Street, 40 foot wide (formally known as Sycamore Street), thence by said southerly line of Heinz Street, 40 foot wide, South 48 degrees 18 minutes 25 seconds East, for a distance of 30.00 feet to a point at the place of beginning.

 

Containing: 12,805.57 Square Feet (0.294 Acre)

 

And also reserving the right of easement of a 15” sewer line and a 6” water line located therein, in the 23rd Ward, 1st Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.

 

Section 2.                       This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on North Canal Street as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $12,750.00.
