Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

Section 1.                     The Pittsburgh Code Title One Administration, Article XI: Personnel Administration, Chapter 185 Vacations, Section 185.03 is hereby amended as follows:

§ 185.03  DURATION.

(a)                     For employees hired on or before June 30, 2004 except where otherwise provided by a collective bargaining agreement, vacation entitlement for full time employees shall be based on years of completed service as follows:

(b)                     For employees hired on or after July 1, 2004, except where otherwise provided by a collective bargaining agreement, vacation entitlement for full time employees shall be based on years of completed service as follows:

Years of                                                                  Approx. Days                                                               Accumulated

City Service                                                                                    Accumulated                                                               Entitlement

Per Pay Period                                          (Days per Year)

(c)                     Since the number of days accumulated per pay period will not multiply to give an employee the exact number of vacation days to which he or she is entitled in each year, an adjustment will be made during the last pay period of each year to ensure that no employee receives more or less vacation time than he or she would be entitled to under the provisions of this section.

(d)                     Once an employee has completed his or her first year as a City employee, vacation will be awarded as if the employee's anniversary date were January 1st.

Section 2.

Current employees that are entitled to a higher rate shall not begin accumulating at that rate until 30 days after the passage of this legislation and shall not be entitled to lost vacation days retroactively that resulted from the June 2004 Act 47 Plan.
