Resolution authorizing the City of Pittsburgh to grant a permanent sanitary sewer easement to the Township of Ross for a new sanitary sewer line across a portion of City property, parcel 114-J-270, on Jacks Run Road a.k.a. Farragut Street, in the 27th Ward, at no cost to the City of Pittsburgh

WHEREAS:   The City of Pittsburgh owns certain property fronting on Jacks Run Road a.k.a Farragut Street, Block 114 J, Lot 270, in the 27th Ward.  This parcel also contains the unplotted cartway of realigned Farragut Street; and
 
WHEREAS:   The Township of Ross in conjunction with the Allegheny County Sanitary Authority, Borough of Bellevue and the City of Pittsburgh Water and Sewer Authority have under taken a project in the Jacks Run water shed to improve the sanitary sewer systems along Jacks Run Road a.k.a, Farragut Street, Brighton Road and Winhurst Street; and
 
WHEREAS:    The Township of Ross desires to obtain a permanent 20 foot wide sanitary sewer easement on a portion of City property, parcel 114-J-270, in line with the unplotted cartway on this parcel to construct a new sanitary sewer at no cost to the City of Pittsburgh.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement with Ross Township for a permanent sanitary sewer easement, 20 feet wide, across City of Pittsburgh property, Block 114 J, Lot 270, in the 27th Ward.  Said agreement shall be in form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as said Solicitor may require.
 
DESCRIPTION OF UTILITY EASEMENT:
 
All that certain permanent sanitary sewer easement, 20 feet wide, situated in the 27th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
 
 
 
 
 
BEGINNING at a point on the edge of Jacks Run Road a.k.a Farragut Street; thence N 47o45'E for a distance of 153.08' to a point at the TRUE PLACE OF BEGINNING; thence N 47o45'E for a distance of 30.34' to a point;  thence through property of now or formerly City of Pittsburgh S 06o31'W for a distance of 233.92' to a point;  thence N 03o37'W for a distance of 35.03' to a point;  thence N 43o39'W for a distance of 18.02' to a point;  thence N 06o31'E for a distance of 165.07' to a point at the TRUE PLACE OF BEGINNING.
 
20 Foot wide permanent sanitary sewer easement as above described, also, a 40.00 foot wide Temporary Construction Easement as shown on Drawing No. JRSEAS4, by DeGlau Engineering to be part of the executed agreement.
 
Section 2.  Be it further resolved that the privilege and easement hereby granted shall be subject to the following terms and conditions:
 
That Ross Township shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent utility easement.
 
That Ross Township shall hereby indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages arising by reason of said construction, installation, maintenance or use.
 
All related costs or charges, if any, shall be paid by Ross Township.
 
That Ross Township agrees to restore the property after installation in
accordance with City of Pittsburgh specifications.
