Resolution vacating Sutherland Drive between Terrace Street and Allequippa Street in the 4th Ward, 8th Council District, of the City of Pittsburgh.

Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Sutherland Drive in the 4th Ward, 8th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
Whereas, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That vacating Sutherland Drive between Terrace Street and Allequippa Street; All that certain portion of Southerland Drive, to be vacated, situate in the 4th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northwesterly right of way line of Terrace Street, 60.00 feet wide, and the westerly right of way line of Sutherland Drive, 50.00 feet wide; thence from said point of beginning by the westerly right of way line of Sutherland Drive the following three (3) courses and distances:
N 53° 42' 00" W a distance of 287.11 feet to a point of curvature; in a northerly direction by a curve bearing to the right having a radius of 338.00 feet through an arc distance of 291.06 feet to a point of compound curvature; in a northerly direction by a curve bearing to the right having a radius of 629.90 feet through an arc distance of 215.10 feet to a point of compound curvature on the southerly right of way line of Allequippa Street, 60.00 feet wide; thence by a line through Sutherland Drive, said line being the southerly right of way line of Allequippa Street as projected, N 45° 01' 40" E a distance of 119.24 feet to a point on the easterly right of way line of Sutherland Drive; thence by the easterly right o f way ling of Sutherland Drive the following three(3) courses and distances: in a southerly direction by a curve bearing to the left having a radius of 579.90 feet through an arc distance of 302.03 feet, also having a chord bearing of S 10° 33' 33" W and a chord distance of 298.63 feet, to a point of compound curvature, in a southeasterly direction by a curve bearing to the left having a radius of 288.00 feet in a through an arc distance of 248.00 feet to a point of tangency; S 53° 42' 00" E a distance of 288.51 feet to a point on the northwesterly right of way line of said Terrace Street; thence by the northwesterly right of way line of said Terrace Street S 37° 54' 30" W a distance of 50.02 feet to a point at the intersection of the northwesterly right of way line of said Terrace Street and the southwesterly right of way line of said Sutherland Drive, at the point of beginning.
Containing an area of 40,620 square feet or 0.933 acre
Also reserving the right of easement of a 15" sewer line and a 6" water line located therein, in the 4th Ward, 8th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Sutherland Drive as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $81,600.00 use of the City of Pittsburgh
