Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-18761, which rescinds approval of Resolution No. 650 of 2002, from Freddy's Restaurant and Lounge, Inc., secured creditor National Builders and Acceptance Corp. c/o Liquor Control Board, to Fratelli's Pizzeria and Company, c/o Rosina Sciulli, 12 Virgila Place, Pittsburgh, PA 15213, for premises at 109-111 Market Street, Pittsburgh, PA 15222 known as MILANO'S PIZZA pursuant to amended Pennsylvania Liquor Code, §4-461.
Section 2. Request for Approval
Fratelli's Pizzeria and Company, c/o Rosina Sciulli, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-18761, which is currently registered to Freddy's Restaurant and Lounge, Inc., secured creditor National Builders and Acceptance Corp. c/o Liquor Control Board, with a mailing address of 227 West 8th Avenue, West Homestead, PA 15120, desires to place a restaurant liquor license into premises known and numbered as 109-111 Market Street, Pittsburgh, PA 15222. The proposed interior of the premises is space for the restaurant business.
Section 3. Public Hearing
City Council shall set a date for Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Fratelli's Pizzeria and Co., c/o Rosina Scuilli's intent to the above liquor license.
Section 4. Approval or Denial of Request
After the Public Hearing which was held February 28, 2006, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove the request of Fratelli's Pizzeria and Company, c/o Rosina Siculli, for inter-municipal transfer of a restaurant liquor license. City Council must approve Fratelli's Pizzeria and Company's request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
