Resolution granting a vacation of Eshelman Street, from Perrysville Avenue to its terminus, at no cost to the City, in the 25th Ward, 1st Council District of the City of Pittsburgh.

WHEREAS, the CLARENCE G COPE, IV, the abutting property owner has requested this vacation, at no cost to the City, to allow for the consolidation of his property.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. All that certain right of way to be vacated, being Eshelman Street, situate in the 25th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northwesterly right of way line of Perrysville Avenue, 50.00
feet wide, and the westerly right of way line of Eshelman Street; thence from said point of beginning by
the westerly right of way line of Eshelman Street N 06° 01’ 22” W a distance of 245.37 feet to a point on
the northerly terminus of Eshelman Street, thence by the northerly terminus of Eshelman Street N 83°
49’ 30” E a distance of 33.22 feet to a point on the westerly right of way line of Federal Street Extension,
50.00 feet wide; thence by the westerly right of way line of Federal Street Extension S 02° 11’ 45” E a
distance of 223.53 feet to a point of curvature on the northwesterly right of way line of said Perrysville
Avenue; thence by the northwesterly right of way line of said Perrysville Avenue in a westerly direction
by a curve bearing to the right having a radius of 25.00 feet through an arc distance of 30.87 feet to a
point at the intersection of the northwesterly right of way line of said Perrysville Avenue and the
westerly right of way line of said Eshelman Street, at the point of beginning.
Said lot or piece of ground containing an area of 6,040 square feet, or 0.139 acres.
Section 2. This portion of the right-of-way is presently open, The Finance Department in line with Law Department policy for a functioning right-of-way, places a price or charge for the vacation of the 6,040 square feet of functioning right-of-way, based on the average assessed value of the adjacent parcels at $3.39 sq ft, at $20,479.48.
Section 3. PW Reserves the Right for a Utility Easement(s): The Sewer and Water Mapping (attached) indicates that there is a 6-inch water main, a 15-inch combined sewer main and two fire hydrants within the proposed street vacation. Pittsburgh Water will require an easement. A copy of the agreement is on file.
Peoples Gas Reserves the Right for a Utility Easement(s): Peoples Gas has indicated they own and operate an 8-inch pipeline in which 300 feet of the line is within the proposed vacated area. Peoples Gas will require an easement.
Section 4. This resolution, however, shall not take effect or be of any force or validity unless CLARENCE G COPE, IV, shall, within sixty (60) days after the effective date of this resolution, remit to the Treasurer, City of Pittsburgh, the sum of twenty thousand, four hundred seventy-nine dollars and forty-eight cents. ($20,479.48).
Section 5. The City Treasurer shall transmit notice to the City Clerk and the City Solicitor upon payment as described in Section 4.
