Resolution authorizing the acceptance of a deed by the City of Pittsburgh for a parcel of real property from Pittsburgh Regional Transit for the purpose of dedicating the property as public park space to be incorporated into Brookline Memorial Park at no cost to the City.

WHEREAS, the Port Authority of Allegheny County, now known as Pittsburgh Regional Transit, is the owner of certain property, designated as Block 96-C, Lot 276 by the Allegheny County Recorder of Deeds, situated in the 32nd Ward of the City of Pittsburgh, Council District 4, located along Brookline Boulevard, and abutting Brookline Memorial Park; and
WHEREAS, Pittsburgh Regional Transit believes their ownership of the parcel is in error, and the rightful owner should be the City of Pittsburgh since the parcel has been historically considered part of Brookline Memorial Park; and
WHEREAS, the City now requests authorization to execute a Deed or Deeds by and between the PRT and the City of Pittsburgh for the transfer of parcel 96-C-276; and
WHEREAS, the City of Pittsburgh now requests authorization to accept the aforementioned Deed or Deeds for the purpose of dedicating the remaining property as public park space; and
WHEREAS, the Council of the City of Pittsburgh believes that the proposed conveyance is in the best interest of the City of Pittsburgh and desires to give its authorization; and
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Director of the Department of Finance, on behalf of the City of Pittsburgh, is authorized to enter into and execute a Deed or Deeds by and between Pittsburgh Regional Transit and the City of Pittsburgh for the transfer of a certain parcel designated as Block and Lot 96-C-276 by the Allegheny County Recorder of Deeds.
Section 2. All Deeds authorized for execution hereunder shall be approved as to form by the City Solicitor and all property acquired hereunder shall be transferred, recorded, and executed at no cost to the City of Pittsburgh.
