Title
Ordinance amending and supplementing the Pittsburgh Code, Title Eight - Fire Prevention, and Title 10 - Building, by electing to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S.  §§7210.101 - 7210.1103, as amended from time to time, and its regulations; the Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 - 405, as amended from time to time; portions of the International Building Code which are not adopted as part of Title 34 - Chapter 1, as amended; Chapter 30; and Appendix B, as amended. Also, reenacting its previously adopted ordinances which were simultaneously repealed by Act 45 as provided for in Title 34 §§403.2 and 403.102(d) and 303(b)(1) of the Act (35 P.S. § 7210.303(b)(1)); and the International Property Maintenance Code, 2003 edition.
Body
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The City of Pittsburgh hereby amends and supplements the Pittsburgh Code, Title Eight - Fire Prevention, and Title 10 - Building, by electing to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S.  §§7210.101 - 7210.1103, as amended from time to time, and its regulations;
 
Section 2. The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 - 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the building code and the fire code of the City of Pittsburgh.
Section 3. In addition to the standards which are referenced in Pa. Title 34, §403.21,          comprising the Uniform Construction Code, the City of Pittsburgh also adopts the following portions of The International Building Code, which are not adopted as part of Title 34:
 a.) Chapter 1, as amended to ensure that it equals or exceeds the requirements of the Code, as provided for in Title 34 §403.102(l) and 503(a) of the Act                           (35 P. S. § 7210.503(a)), to provide a convenient reference for all the administrative provisions of the Code as they pertain to the City of Pittsburgh.
 
b.) Chapter 30, which contains the building code requirements for elevators, elevator shafts and elevator equipment rooms, as specifically allowed for by section 302(b) of the Act  (35 P. S. § 7210.302(b)).
c.) Appendix B, as amended, which contains the provisions for the establishment of a board of appeals as mandated by section 501(c) of the act (35 P. S. § 7210.501(c)).
 
Section 4. The City of Pittsburgh also reenacts its previously adopted ordinances which were simultaneously repealed by Act 45 as provided for in Title 34 §§403.2 and 403.102(d) and 303(b)(1) of the Act (35 P. S. § 7210.303(b)(1)).  These ordinances are set forth in Exhibit "A", attached.
 
Section 5. The City of Pittsburgh adopts for the purpose of protection of public health, safety and welfare in all existing structures that certain code known as the International Property Maintenance Code, 2003 edition, as published by the International Code Council, except such portions thereof that are amended.  Said amendments are set forth in Exhibit "B". Section 6.  All relevant ordinances, regulations and policies of the City of Pittsburgh not governed by the Code shall remain in full force and effect.
 
Section 7.      Fees assessable by the City of Pittsburgh for the administration and enforcement undertaken pursuant to this ordinance and the Code shall be established by resolution.
Section 8.      This ordinance shall be effective July 9 8, 2004.
 
Section 9.      If any section, subsection, sentence, or clause of this ordinance is held, for any reason, to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this ordinance.
