Title
Resolution authorizing the Mayor and/or the Directors of the Departments of Engineering and Construction and/or Public Works to enter into a Contract or Contracts, or an Agreement or Agreements, with the Commonwealth of Pennsylvania Department of Transportation for the respective maintenance responsibilities of the City and the Commonwealth following the improvements performed during 2002 – 2003 on State Routes 0376, 0279, 8041 and 8095, all of which are located within the City limits.

WHEREAS, certain roadway improvements were performed on portions of State Routes 0376, 0279, 8041 and 8095, all of which are located within the City limits, pursuant to various agreements between the City and the Commonwealth of Pennsylvania; and
WHEREAS, the roadway improvements have been completed; and
WHEREAS, the City and the Commonwealth desire, in the best interests of each of them, to formalize in a maintenance agreement their various maintenance responsibilities for the aforesaid roadways;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and/or the Director of the Department of Public Works and/or the Director of the Department of Engineering and Construction, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Contract or Contracts, or an Agreement or Agreements, with the Commonwealth of Pennsylvania Department of Transportation setting forth the specific maintenance responsibilities required by law and/or agreed to by each of them with respect to those portions of State Routes 0376, 0279, 8041 and 8095 within the City limits and those portions of Legislative Routes 764 and 766, also known as Fort Pitt Boulevard East Bound/Interstate Connector, and related roadway structures, facilities and appurtenances, which were the subject of the construction and reconstruction project named Fort Pitt Boulevard-EB/Interstate Connector-SR279/A33 and performed pursuant to prior authorizations of Pittsburgh City Council, specifically No. 38 of 2000, No. 509 of 2000, No. 585 of 2001, No. 493 of 2001 and No. 877 of 2001. The Agreement or Agreements or Contract or Contracts authorized hereby shall be in a form satisfactory to the City Solicitor. PennDOT will reimburse the City of Pittsburgh for the costs of maintenance services provided by the City of Pittsburgh for Penn DOT, at the terms, conditions and rates outlined in the said Maintenance Agreement between the two entities.
