Resolution authorizing the Mayor, the Director of Public Works, and the Director of Finance to enter into an easement agreement or agreements with the Allegheny County Sanitary Authority for the installation of certain monitoring boreholes on City-owned parcel IDs 121-H-20 and 82-H-1-0-2 and 48-H-200, at no cost to the City.

WHEREAS, the City (“the Grantor”) is the owner in fee simple of that certain parcel of real property located in the 10th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, being identified as Parcel Tax ID No. 121-H-20 (101 Reservoir Drive, Council District 7).
WHEREAS, the City is the owner in fee simple of that certain parcel of real property located in the 11th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, being identified as Parcel Tax ID 82-H-1-0-2 (101 Reservoir Drive, Council District 7).
WHEREAS, the City is the owner in fee simple of that certain parcel of real property located in the 6th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, being identified as Parcel Tax ID 48-H-200 (36th Street, Council District 7).
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor, the Director of Public Works, and the Director of Finance, on behalf of the City of Pittsburgh, are authorized to enter into an agreement or agreements with the Allegheny County Sanitary Authority to provide an easement on parcel 121-H-20 for the installation, access, monitoring, and maintenance of an observation well and/or a monitoring borehole.
Section 2. The Mayor, the Director of Public Works, and the Director of Finance, on behalf of the City of Pittsburgh, are authorized to enter into an agreement or agreements with the Allegheny County Sanitary Authority to provide an easement on parcel 82-H-1-0-2 for the installation, access, monitoring, and maintenance of an observation well and/or a monitoring borehole.
Section 3. The Mayor, the Director of Public Works, and the Director of Finance, on behalf of the City of Pittsburgh, are authorized to enter into an agreement or agreements with the Allegheny County Sanitary Authority to provide an easement on parcel 48-H-200 for the installation, access, monitoring, and maintenance of an observation well and/or a monitoring borehole.
Section 3. Conditions of Approval:
A. Protect existing natural assets
i. During test boring and tunnel construction, avoid impacts to the two mature ash trees identified through the Ash Tree Restoration Project as #105 and #106.
B. Restore and improve disturbed areas after test borings and as part of the Allegheny River Tunnel project
i. Fully restore any construction-affected land, trails, parking areas, and recreational spaces.
ii. Reconstruct the parking lot using pervious materials where feasible.
iii. Replant trees and strengthen hillside vegetation to support trail connectivity around Highland Park.
iv. Restore the Cat Tail Trail connection to the parking lot.
v. Incorporate green stormwater infrastructure to mitigate new impervious surfaces associated with access roads and construction areas.
C. Engage across agencies and stakeholders designing the future of lower Negley Run
i. Continue meaningful community involvement during design, review, and construction to ensure project improvements reflect neighborhood priorities and long-term environmental goals.
ii. Ensure ongoing coordination among ALCOSAN, Pittsburgh Water, PennDOT, the City of Pittsburgh, local Registered Community Organizations (RCOs), and the Brilliant Waterways & Woodlands Coalition to align tunnel construction with broader watershed and flood mitigation goals.
D. Design to accommodate community priorities at both the A41 and A42 sites
i. Design the A42 access shaft, portal, and surface facilities to accommodate and reinforce planned stormwater conveyance and flood-control projects in the A42 sewershed to ensure the project positively contributes to flood reduction in the A42 sewershed generally, and in the area of Washington Boulevard specifically.
ii. Design the A41 access shaft, portal, and surface facilities to accommodate and reinforce public river access as part of project development and construction.
Section 4. Said agreements shall be approved by the City Solicitor as to form.
The Easements and Easement Areas are depicted on the drawings that are attached hereto as Exhibit A.
