Title
Resolution Authorizing the Mayor and the Director of the Department of Public Safety or the Chief of the Bureau of Emergency Medical services to enter into an agreement with Philips Medical Systems NA to facilitate this donation of HeartStart MRx monitors/defibrillators, to have access to necessary operating software, and to ensure for necessary care and maintenance of the Devices at a cost not to exceed $42,771.

Whereas, Philips Medical Services, the University of Washington Clinical Trial Center, and Laerdal Medical AS are working together to conduct a clinical study (the “Study”) to determine certain benefits of new HeartStart MRx monitors/defibrillators (the “Devices”) and have offered such Devices at no cost to various public safety agencies in exchange for participating in the Study; and
Whereas, the City's Bureaus of Emergency Medical Services (“EMS”) and Fire have determined that it will be in the best interest of the City and its residents to participate in this Study; and
Whereas in consideration for participating in the Study, the City's Bureau of EMS will receive 53 Devices at no cost for said equipment; and
Whereas, the City's only costs in participating in this study will relate to a required concurrent service agreement to ensure the proper care and maintenance of the Devices; and
Whereas, the City's Bureau of EMS wishes to participate in the Study and enter into Agreements with Philips Medical Services to facilitate this donation of the Devices, to have access to necessary operating software, and to ensure for necessary care and maintenance of the Devices.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Public Safety or the Chief of the Bureau of Emergency Medical Services are hereby authorized to enter into an Agreement or Agreements with Phillips Medical Systems NA (or another division of Phillips Medical Systems), including an Equipment Provision Agreement and Standard Terms and Conditions, a License Agreement for Operating Software, and a Customer Services Agreement for the donation of 53 Heart Start ALS MRx monitors/defibrillators, to have access to necessary operating software therefore, and to ensure for necessary care and maintenance of the Devices. The cost of the service agreement for Year 1 shall not exceed Forty Two Thousand, Seven Hundred Seventy-One Dollars ($42,771.00) payable from Fund 1000, Org. 220000, Account 557700, Subclass 130, BY 2007.
Section 2: So long as the service agreement remains in effect, the City Controller shall encumber funds for an additional four years for the said service agreement from and subject to the amount of funds to be appropriated annually by City Council in respective budget years from: Fund 1000, Org. 220000, Account 557700, Sub class 130. The annual amount for each successive year shall not exceed Forty Two Thousand Seven Hundred Seventy-One Dollars ($42,771.00) per year.
