Resolution authorizing the Mayor and the Director of the Department of Finance to enter into Access Agreements with Collective Efforts, LLC, for two City-owned sites located at 700 Herron Avenue and 3300 Webster Avenue to conduct a Phase II Environmental Assessment and further authorizing the Mayor and Director of the Department of Finance to enter into any necessary agreement or agreements with North Side Industrial Development Company to document the terms of its use of U.S. Environmental Protection Agency grant funds to cover the costs of these assessments.

WHEREAS, the North Side Industrial Development Company (“NSIDC”) has received a grant from the United States Environmental Protection Agency (“EPA”) to conduct environmental assessments on brownfield sites with the potential for contamination; and
WHEREAS, with such grant funding, NSIDC has offered to conduct Phase II Environmental Assessments at two City-owned former gas station sites located at 700 Herron Avenue (Lot and Block 26-N-24) and 3300 Webster Avenue (Lot and Block (26-N-059), which would include, inter alia, preparing a Sampling and Analysis Plan; conducting asbestos sampling and soil and groundwater sampling; and removing any underground storage tanks and replacing them with clean fill (collectively, the “Assessment Work”); and
WHEREAS, NSIDC has engaged a consultant, Collective Efforts, LLC, a civil and environmental engineering firm, to perform the Assessment Work; and
WHEREAS, the cost of the Assessment Work will be One Hundred Twenty-Four Thousand, Five Hundred Dollars ($124,500.00), which costs will all be covered by the EPA grant and at no cost to the City; and
WHEREAS, completion of these remediation efforts will position these sites for future reuse, which will benefit the City and the public; and
WHEREAS, the City now wishes to enter into Access Agreements with Collective Efforts, LLC, to authorize the Assessment Work and to enter into any additional agreement or agreements with NSIDC as may be necessary to document the terms of its use of U.S. Environmental Protection Agency grant funds to cover the costs of these assessments.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to enter into Access Agreements with Collective Efforts, LLC to authorize Phase II Environmental Assessments to occur at 700 Herron Avenue (Lot and Block 26-N-24) and 3300 Webster Avenue (Lot and Block (26-N-059) at no cost to the City and are further authorized to enter into any additional agreement or agreements with North Side Industrial Development Company as may be necessary to document the terms of its use of U.S. Environmental Protection Agency grant funds to cover the costs of these assessments. The form of the Access Agreements and any other required agreements will be approved by the City Solicitor.
