Title
Resolution granting the Pittsburgh Water and Sewer Authority a permanent utility easement and the privilege and license to install, use, operate, maintain, repair, renew and finally remove an eight inch water line across City of Pittsburgh property designated as Block 3-R-231 located on Arlington Avenue in the 18th Ward.
 
Body
WHEREAS: The City of Pittsburgh owns certain property at 1000 Arlington  Avenue, Block 3-R, Lot 231 in the 18th Ward being a steep wooded hillside not suitable for development to be held for permanent City ownership.
 
WHEREAS: The Pittsburgh Water and Sewer Authority needs to install an eight inch water line to connect Fritz Street line to the Hartford Street line using the favorable topography in the City parcel.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement with the Pittsburgh Water and Sewer Authority for a permanent utility easement across City of Pittsburgh property Block 3-R, Lot 231 on Arlington Avenue. Said Agreement shall be in the form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as said Solicitor may require.
 
Description of Utility Easement.
This utility Easement known as PWSA Project 03017 Hartford-Fritz, and shown on Attachment "A" is a 20 foot wide utility easement across the bottom portion of Block 3-R, Lot 231 being described as follows:
 
BEGINNING at a point on the Northeast corner of City of Pittsburgh parcel 3-R-231 on the Southern right-of-way line of Hartford Street said point being 77.00 feet West of the Southwest corner of Hartford Street, 40 feet wide and Fritz Street, 15 feet wide; thence from said point of beginning North 87° 57' East a distance of 20.57 feet along said Southern right-of-way line of Hartford Street; thence south 15°33' East a distance of 136.23 feet to a point on the Western right-of-way line of Fritz Street; thence South 8° 35' West a distance of 48.90 feet along the Western right-of-way line of Fritz Street to a point of intersection with the Southeast corner of parcel 3-R-231 and Fritz Street; thence North 15° 33' West a distance of 185.65 feet to a point at the PLACE OF BEGINNING. Containing 3,218 Square feet.
 
 
SECTION 2.  The privilege and easement hereby granted shall be subject to the following items and conditions:
 
A)      The Pittsburgh Water and Sewer Authority shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent utility easement.
B)      The Pittsburgh Water and Sewer Authority shall hereby indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages arising by reason of said construction, installation, maintenance or use.
