Resolution vacating portions of Cremo Street, Zinc Way, West Canal Street, Waino Way, Dasher Street, Burdock Way, Mass Transit Street, Martindale Street and Itasco Street in the 22nd Ward, 6th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that all owners of the property fronting or abutting on the line of Cremo Street, Zinc Way, West Canal Street, Waino Way, Dasher Street, Burdock Way, Mass Transit Street, Martindale Street and Itasco Street, in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:
SECTION 1. That vacating Cremo Street, 40' wide, from West General Robinson Street northward to SR 279 right-of-way a distance of 183.67 feet containing 7,204.66 square feet.
Zinc Way, 10' wide, from Cremo Street east to West Canal Street a distance of 120 feet containing 1,200 square feet.
West Canal Street, 30' wide from West General Robinson Street northward to SR 279 right-of-way a distance of 202.18 feet containing 6,065.89 square feet.
Waino Way, 10' wide from West General Robinson Street northward to SR 279 a distance of 202.07 + feet containing 2,020.72 square feet.
Dasher Street, 50' wide, from West General Robinson Street northward to SR 279 an average distance of 202 + feet containing 10,098.19 square feet.
Burdock Way, 10' wide, from West General Robinson Street northward to SR 279 a distance of 202.4 feet containing 2,024.13 square feet.
A triangular portion of Mass Transit Street, located at the northern corner of West General Robinson Street, S 76° 31' 51” W, .34' feet; N 58° 11' 11” W, 12.91' feet, N 76° 44'24” E, 9.38' feet; S 13° 46' 54” E, 9.14' feet, containing 44.39 square feet.
Martindale Street, Beginning at a point on the easterly line of Merchant Street and the northerly line of Martindale Street (54.00' wide) thence along the base of the wall on the northerly line of Martindale Street N 75° 15' 00” E, 155.45 feet to a corner of wall; thence continuing along the base of wall S 73° 22' 00” E, 146.54 feet to a corner of wall on the easterly line of Cremo Street (40 feet wide); thence by the dividing line between Cremo Street and Martindale Street S 46° 11' 30” W, 45.98 feet to a point on the southerly line of Martindale Street; thence along the southerly line of Martindale Street N 73° 22' 00” W 85.73 feet to a point; thence continuing along the southerly line and building line of Martindale Street S 75° 15' 00” W 167.18 to a point; thence by the projected easterly line of Merchant Street N 14° 45' 00” W 54.00 feet to the point at the place of beginning. Containing an area of 13,356 square feet more or less.
Cremo Street, Beginning at a point on the northerly line of Martindale Street and the easterly line of Cremo Street (40' wide) and on the required right-of-way line for limited access of State Route 4082; thence along the right-of-way line of State Route 4082 and the easterly line of Cremo Street S 14° 15' 00” E 58.76 feet to a point on the northerly line of a 15.00' wide substitute right-of-way for Equitable Gas Energy Company; thence along the northerly line of the Equitable Gas Energy Company right-of-way S 50° 59' 12” W 44.05 feet to the westerly line of Cremo Street; thence along the westerly line of Cremo Street N 14° 15' 00” W 54.53 feet to a point at the dividing line between Martindale Street and Cremo Street; thence by said dividing line N 46°11' 30” E 45.98 feet to the point at the place of beginning. Containing an area of 2,265 square feet more or less.
Itasco Street, Beginning at a point on the southerly line of Martindale Street and the westerly line of Itasco Street (20 feet side); thence along the southerly line of Martindale Street N 75°15' 00” E 20.00 feet to a point on the easterly line of Itasco Street; thence by the easterly line of Itasco Street S 14° 38' 16” E 129.07 feet to a point on the northerly line of Reedsdale Street (40 feet wide); thence along the northerly line of Reedsdale Street S 75° 15' 00” W 20.00 feet to the westerly line of Itasco Street, thence by the westerly line of Itasco Street N 14° 38' 16” W 129.07 feet to the point at the place of beginning. Containing an area of 2,581 square feet more or less.
And also, but specifically reserving the right of easement of the 54” x 72” sewer line and two 6” water lines on Martindale Street; reserving the right of easement of the 54” x 72” sewer line on Itasco Street; reserving the right of easement of a 24” sewer line on Cremo Way; reserving the right of easement of the 15” sewer line on Waino Way; abandoning the 6” water line on West Canal Street; reserving the right of easement for the 15” sewer line on Burdock Way; reserving the right of easement for the existing 15” sewer line and 33” sewer line. The 33” sewer line may be abandoned when a new 36” storm sewer is built, which will also require an easement. The 6” water line may be abandoned all on Dasher Street. A 20' easement for maintenance for the above water and sewer lines must be maintained, all in the 22nd Ward, 6th Council District of the City of Pittsburgh.
SECTION 2. Any Resolution or Ordinance or part thereof conflicting with the provisions of this resolution is hereby repealed so far as the same affects this Resolution.
