Resolution providing for the acceptance by the City of Pittsburgh from Green Development Inc. of certain described property on Arlington Avenue in the 18th Ward for public greenway purposes at no cost to the City of Pittsburgh.

 

Body

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  The Mayor of the City of Pittsburgh and the Director of the Department of Finance on behalf of the City of Pittsburgh are authorized to accept a deed from Green Development Inc. conveying certain property as designated below to become part of Greenway, to be used as public greenway purposes, in fee simple, and at no cost to the City of Pittsburgh.

 

PROPERTY DESCRIPTION

 

All that certain lot or piece of ground situate in the 18th Ward of the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being part of Parcel “A” in the Sota Plan of Lots recorded in Plan Book Volume 236, pages 3 and 4, in the Recorder's Office of Allegheny County and being bounded and described as follow, to wit:

 

BEGINNING at a point on the northeasterly line of Arlington Avenue (as relocated) at the dividing line of the above mentioned Parcel “A” and property now or formerly Edwin R. Miller, Jr.; thence along the northeasterly line of Arlington Avenue by the arc of a circle curving to the left and having a radius of 365.00 feet for an arc distance of 30.83 feet to a point on the dividing line between said Parcel “A” and property now or formerly the School District of Pittsburgh; thence leaving the northeasterly line of Arlington Avenue and traveling along the dividing line between Parcel “A” and property now or formerly the School District of Pittsburgh the following three (3) courses and distances:  North 26o45' East a distance of 90.42 feet to a point;  thence North 64o05' West a distance of 21.50 feet to an existing pin;  thence South 26o45' West a distance of 75.41 feet to a point on the northeasterly line of Arlington Avenue;  thence along the northeasterly line of Arlington Avenue by the arc of a circle curving to the left and having a radius of 365.00 feet for an arc distance of 52.30 feet to a point on the southeasterly line of property now or formerly the City of Pittsburgh.;  thence leaving Arlington Avenue and traveling along the southeasterly line of property now or formerly the City of Pittsburgh;  North 26o45' East a distance of 70.68 feet to a point on the dividing line of Parcel “A” and Lot 1 in the Sota Plan of Lots;  thence along said dividing line between Parcel “A” and Lot 1, South 63o43'30” East a distance of 144.51 feet to a point on the northwesterly line of property formerly John Kawa, et ux.;  thence along said dividing line between Parcel “A” and property formerly John Kawa, et ux. South 26o45' West a distance of 19.74 feet to an existing pin being the northeast corner of property now or formerly Edwin R. Miller, Jr.; thence along the dividing line between Parcel “A” and property now or formerly Edwin R. Miller, Jr. the following two (2) courses and distances:  North 64o05' West a distance of 53.00 feet to an existing pin;  thence South 26o45' West a distance of 110.10 feet to a point on the northeasterly line of Arlington Avenue at the PLACE OF BEGINNING. 

 

 

The above-described parcel contains an area of 8,175 square feet or 0.1877 acres.

 

The acceptance of this vacant land, containing 8,175 square feet, is contingent upon the acquisition of 16,979 square feet of vacant City land by Green Development Inc. being described as part of Lot 1 in the Sota Plan of Lots approved by the City Planning Commission on July 16,     2002 and recorded in Plan Book Volume 236, pages 3 and 4, in the Recorder's Office of Allegheny County.
