Resolution authorizing the Director of the Department of Finance and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, to enter into certain permanent and temporary construction easements in order to advance the Trolley Trail project, at no cost to the City.

WHEREAS, the City of Pittsburgh is currently advancing the Trolley Trail project (the “Project”) along Noblestown Road in the 28th Ward of the City, and;

 

WHEREAS, as part of the Project, the City of Pittsburgh must install and construct a drainage pipe or pipes on or under a certain parcel of property (19-J-18, 28th Ward) (the “Property”) near the Project area, and;

 

WHEREAS, the City of Pittsburgh seeks to enter into a temporary construction easement with the owner of the Property to allow for access and general Project-related construction activities, including the installation and construction of the drainage pipe or pipes necessary to advance the Project, and;

 

WHEREAS, the City of Pittsburgh additionally seeks to enter into a permanent easement with the owner of the Property to allow for the drainage pipe or pipes to remain on or under the Property indefinitely and to allow for the continued maintenance and repair of the drainage pipe or pipes.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1. The Director of the Department of Finance and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, are authorized to enter into a temporary construction easement for construction purposes on the Property necessary to advance the Trolley Trail project, as set forth further in the graphics attached hereto and incorporated herein as Exhibits A and B respectively.

 

Section 2. The Director of the Department of Finance and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh, are authorized to enter into a permanent easement for the purpose of installing, constructing, operating, and maintaining a permanent drainage pipe or pipes on or under the Property as set forth further in the graphics attached hereto and incorporated herein as Exhibits A and B respectively.

 

Section 3. The permanent and temporary construction easements shall be approved by the City Solicitor as to form and substance.
