Title
Resolution authorizing the City of Pittsburgh to issue quit claim deed for property in the 31st Ward of the City of Pittsburgh, designated as Block 134-B-part of Lot 316 to the Pennsylvania Department of Transportation for the sum of $1.00, and further to authorize a temporary construction easement on the same parcel Block 134-B- part of lot 316 for the sum of $1.00.
Body
Whereas, the City of Pittsburgh owns certain property in the 31st Ward, designated as Block 134-B- part of Lot 316 and
 
Whereas, The Pennsylvania Department of Transportation requires a portion of said parcel, containing 4,398.5 Square feet to construct an open channel for water drainage, and
 
Whereas, This portion of the larger City parcel is no longer needed by the City of Pittsburgh, and
 
Whereas The Pennsylvania Department of Transportation also requires a temporary construction easement of 1,779.3 Square feet adjacent to this acquisition to complete construction.
 
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      That the proper officers of the City of Pittsburgh are hereby authorized to execute and deliver a quit claim deed in form approved by the City Solicitor and the Pennsylvania Department of Transportation for the sum of One Dollar ($1.00) and also a temporary construction easement for the sum of One Dollar ($1.00) for the following described properties:
 
Acquisition Property Description
ALL THAT CERTAIN LOT or piece of ground situate in the 31st Ward of the City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania being part of Lot Numbers 1 and 2 in the Doerr Terrace Plan of Lots in Plan Book Volume 19, Page 194 being bounded and described as follows:
BEGINNING at a point on the Northerly line of Mifflin Road at the dividing line between Block and Lot Numbers 134-B-316 and 134-A-245; thence Westerly along  Mifflin Road  North 44º07'13'' West a distance of 22.27 feet to a point; thence continuing along Mifflin Road along an arc curving to the left with an arc distance of 47.73 feet having a radius of 1837.50 feet the cord of which is North 45º36'31" West; thence Northward along the dividing line between Block and Lot Numbers 134-B-316 and 134-A-229 North 45º20'10" East a distance of 63.29 feet to a point; thence continuing Easterly, South 44º14'42" East a distance of 56.31 feet to a point; thence continuing South 75º54'21" East a distance of 15.70 feet to a point on the dividing line between Lot 134-B-316 and 134-A-245; thence South 45º52'47" West a distance of 70.83 feet to a point at the PLACE OF BEGINNING.  Containing 4,398.5 square feet of area.
BEING designated as Block 134-B part of lot 316 in the Deed Registry Office of Allegheny County, Pennsylvania.
BEING part of the same property which the Treasurer of the City of Pittsburgh by deed dated October 18, 1950 filed in the Department of Court Records-Civil/Family Division of the Allegheny County in Treasurer's Deed Book Volume 8, page 248 being Sale Number 2478 of December 4, 1950 conveyed to the City of Pittsburgh.
Construction Easement Property
ALL THAT CERTAIN LOT or piece of ground situate in the 31st Ward of the City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania being part of Lot Number 1 and 2 the the Doerr Terrace Plan of lots in Plan Book Volume 19, Page 194 described for the purpose of a temporary construction easement being bounded and described as follows.
BEGINNING at a point along the dividing line between Block and Lot Numbers 134-B-316 and 134-A-245 said point being 70.83 feet from the Northerly line of Mifflin Road; thence North 75º54'21" West a distance of 15.70 feet to a point; thence continuing North 44º14'42" West for a distance of 56.31 feet to a point and the dividing line between Block and Lot Numbers 134-B-316 and 134-A-229; thence Northward along said dividing line North 45º20'10" East a distance of 10.91 feet to a point; thence South 69º04'26" East a distance of 62.13 feet to a point; thence continuing South 44º14'42" East a distance of 13.00 feet to a point on the dividing line between Block and Lot Numbers 134-B-316 and Block 134-A-245; thence South 45º52'47" West a distance of 28.98 feet to a point at the PLACE OF BEGINNING. Containing 1,779.3 square feet of area.
 
Section 2.      BE IT FURTHER RESOLVED that the said conveyance shall be subject to the following terms and conditions:
 
A.       ALL State and local transfer taxes, if any, shall be paid by the purchaser.
B.      ALL proper closing charges shall be paid by the purchaser
