MOTION BY COUNCILMAN DEASY TO WAIVE THE RULES OF COUNCIL TO PLACE THIS BILL ON THE SCM AGENDA.

 

Title

Resolution authorizing the Mayor and the Director of Public Works to enter into an Agreement or Agreements with Pittsburgh Roars to permit the installation of a Temporary Art exhibition on public property owned and/or regulated by the City of Pittsburgh. 

 

Body

                     WHEREAS, City is charged with the duty of regulating activities occurring on City property and within the public rights-of-way located within the City; and

 

                     WHEREAS, Pittsburgh Roars desires a permit to install and maintain a temporary art exhibition of one or more inflatable animals and/or figures (the "Exhibition") on one or more sites under the jurisdiction of the City to promote and publicize public art and to attract new visitors to the City of Pittsburgh; and

 

                     WHEREAS, the first site designated for the placement of the inflatable entitled  "Like a Lionfish Out of Water" is the City-County Building Portico and other sites may additionally be requested to be added to the Exhibition at a later date; and

 

                     WHEREAS, the City intends to designate the aforementioned Exhibition as a limited public forum; and 

 

                     WHEREAS, City and Pittsburgh Roars desire to enter into an agreement specifying rights and obligations with respect to the installation, operation and maintenance of the Exhibition;

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director Public Works are hereby authorized to enter into an agreement or agreements with Pittsburgh Roars to set forth the duties and responsibilities of the parties with respect to the installation, operation, and maintenance of the Exhibition. The final Agreement shall be in a form approved by the City Solicitor.

 

Section 2.                     The Agreement shall include among its terms the following condition:

 

All Site locations on City property or within the public right of way regulated by the City shall be subject to the approval of the Directors of the Departments of General Services and Public Works.
