Title

Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into an agreement or agreements with the Commonwealth of Pennsylvania, Department of Transportation (“PennDOT”), and/or the Oakland Transportation Management Association (“OTMA”), and/ or the University of Pittsburgh of the Commonwealth System of Higher Education (the “University”), including but not limited to agreements for cooperation, access, inspection and reimbursement, regarding the implementation and management of a Pedestrian Safety and Mobility Project for certain intersections on Forbes and Fifth Avenues in the Oakland portion of the City of Pittsburgh. 

 

Body

WHEREAS, the OTMA has received the award of a Hometown Streets grant (Grant 1) from PennDOT, which grant will consist of Transportation Enhancement federal funding from the United States Department of Transportation Federal Highway Administration in the amount of $1 million to be utilized for the Oakland Forbes/Fifth Pedestrian Safety and Mobility Project (the “Project”), a Hometown Streets/Safe Routes to School program; and

 

WHEREAS, the City has also received a Hometown Streets grant (Grant 2) from PennDOT of Transportation Enhancement federal funding for the Project in the amount of $483,000; and  

 

WHEREAS, the City, PennDOT and OTMA have agreed to combine the Grants for the purposes of the Project; and

 

WHEREAS, the Oakland Business Improvement District (“OBID”) has agreed to and has granted the Project $63,000 for design and survey work; and

 

WHEREAS, the University has committed to appropriate and has appropriated the total sum of $250,000 for design, survey and pre-construction work for the Project; and  

 

WHEREAS, the Project contemplates the planning, designing and constructing of improvements to certain Fifth Avenue intersections and certain  Forbes Avenue intersections all in the Oakland section of Pittsburgh; and

 

WHEREAS, for purposes of the agreement or agreements, the street, sidewalk and adjacent curb and related fixture improvements are hereby collectively defined as the “Work”; and

 

WHEREAS, Forbes Avenue is owned by the Commonwealth of Pennsylvania and maintained by the City of Pittsburgh, and Fifth Avenue owned and maintained by the City, both of which are desirous of the intended improvements and shall facilitate shall act as Sponsors for the purpose of receiving, administering and arranging for the Transportation Enhancement Program, Federal Aid Reimbursement Agreement (the “Reimbursement Agreement”) from PennDOT; and

 

WHEREAS, the University has offered its services in connection with the Project to pay for the design, management of the surveying and pre-construction activities and to act as the Construction Manager for the Project; and

 

WHEREAS, the City, PennDOT and OTMA have agreed to engage the University as their agent to manage the implementation of the design and construction phases for the Project; and

 

WHEREAS, the University has also agreed to manage the bidding for the contractors who will perform the Work on the Project; and

 

WHEREAS, the City, PennDOT and OTMA have approved the plans and specifications for the Project and the plans and specifications for the Work; and

 

WHEREAS, in order to implement the details of the University's agency and management relationship with the City, PennDOT and OTMA, the parties desire to enter into an agreement or agreements setting forth their respective responsibilities; and

 

WHEREAS,  the parties will need in due course to enter into various agreements including but not limited to reimbursement agreements and agreements addressing the performance of inspection services and the right to perform work on City property;

                     

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Public Works are hereby authorized to enter into an agreement or agreements with the Commonwealth of Pennsylvania, Department of Transportation (“PennDOT”), and/or Oakland Transportation Management Association (“OTMA”), and/or the University of Pittsburgh of the Commonwealth System of Higher Education (the “University”), including but not limited to agreements for cooperation, access, inspection and reimbursement, regarding the implementation and management of  a Pedestrian Safety and Mobility Project for certain intersections and street lighting improvements on Forbes and Fifth Avenues in the Oakland portion of the City of Pittsburgh. 

 

Section 2.                     The agreement or agreements shall be subject to the approval of the City Solicitor as to form and substance.
