Resolution authorizingthe City of Pittsburgh to accept part of Port Authority of Allegheny County parcel 15 F, Lot 250, in the 18th Ward.
 
Body
WHEREAS:    The City of Pittsburgh owns certain property in the 18th Ward, designated as parcel 34-D, Lot 20, commonly known as McKinley Park; and
 
WHEREAS:      The Port Authority for the specific purpose of re-aligning the Overbrook Transit line requires a portion of parcel 34 D, Lot 20, owned by the City of Pittsburgh; and
 
WHEREAS:       The City of Pittsburgh agrees to accept an equal amount of Port Authority property, parcel 15 F, Lot 250, for City land required for re-alignment of the transit line
 
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:
 
SECTION 1.      That the proper officers of the City of Pittsburgh are hereby authorized to accept a deed in fee simple, in form approved by the City Solicitor, from the Port Authority of Allegheny County for part of parcel 15 F, Lot 250, containing 24,425 square feet of land more fully described as follows:
 
      STARTING at a point which is the intersection of the northerly right of way line of the middle branch of Bon-Air Avenue (40 feet wide), the easterly right of way line of Dane Way (15 feet wide), and the subject property; thence along said easterly right of way line of Dane Way (15 feet wide) North 23o40'38" West a distance of 105.15 feet to the POINT OF BEGINNING: thence across the subject property by the following five calls: by a curve to the right with radius of 475.54 feet, an arc distance of 21.56 feet, and chord bearing South 20o23'38" West; North 23o40'54" West a distance of 91.03 feet; a curve to the left with radius of 415.54 feet, an arc distance of 278.29 feet, and chord bearing North 6o22'19" West; North 25o33'28" West a distance of 531.39 feet; and a curve to the left with radius of 2,155.96 feet, arc distance of 250.69 feet, and chord bearing North 28o53'28" West to a point on the westerly legal Right of Way Line of the Port Authority of Allegheny County, thence along the westerly legal Right of Way Line of the Port Authority of Allegheny County by the following ten calls:  North 56o48'07" East a distance of 5.37 feet; by a curve to the right with radius of 3277.79 feet, arc
 
distance of 240.85 feet, and chord bearing South 30o49'38" East; South 28o43'20" East a distance of 374.94 feet; a curve to the right with radius of 1021.12 feet, arc distance of 306.09 feet, and chord bearing South 20o08'04" East; South11o32'49" East a distance of 9.96 feet; South 77o34'47" West a distance of 11.18 feet; South 12o26'26" East a distance of 24.26 feet; South 1o02'01" East a distance of 65.65 feet; South 11o01'36" East a distance of 73.69 feet; and South 36o50'12" East a distance of 15.17 feet to a point;  thence across the subject property by a curve to the right with radius of 475.54 feet, an arc distance of 30.02 feet, chord bearing South 17o17'11" West to the POINT OF BEGINNING.
 
CONTAINING an area of 25,425 square feet as per plan prepared by S. E. Technologies, Inc. for the Port Authority of Allegheny County dated 5-31-00, revised 8-15-00 and 6-6-01.  Drawing number 980349-100 and cross section SK890 dated 5-31-00.
 
SECTION 2.      That said conveyance shall be subject to the following terms and conditions:
 
All state and local transfer taxes shall be paid by the Port Authority of Allegheny County, if any
 
All property closing charges shall be paid by the Port Authority of Allegheny County.
 
C.  The Port Authority of Allegheny County shall revegetate all lands to be transferred to the City for inclusion in McKinley Park with vegetation indigenous to the area.
