Title
An Ordinance supplementing the Pittsburgh Code, Title Nine, Zoning, Chapter 911.04.A.93—Public Information Kiosks, by adding additional language relative to oversight by the City of Pittsburgh Art Commission, and also requiring notification to adjacent property owners by adding the following subsections (e), (f) and (g).

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Supplementing the Pittsburgh Code, Title Nine, Zoning, Chapter 911.04.A.93—Public Information Kiosks, by adding Subsections (e), (f) and (g), as follows
911.04.A.93 Public Information Kiosks
(a) Public Information Kiosks shall have a maximum vertical dimension of not greater than ten (10) feet and a maximum horizontal dimension of the kiosk body of not greater than six (6) feet;
(b) Public Information Kiosks shall have a maximum of two (2) signs and (1) public information panel or one (1) back-to-back sign that includes one (1) information panel and:
(1) does not exceed twenty-four (24) square feet in face area per sign;
(2) does not exceed the height of the structure; and
(3) does not extend more than five (5) inches from the structure and is integral to the design;
(c) Public Information Kiosks must be installed as part of a public information program under the direction of, or approved by, the City of Pittsburgh; and
(d) Public Information Kiosks outside the public right-of-way are required to have a Certificate of Occupancy.
(e) The City of Pittsburgh Art Commission must review and make a recommendation to the Zoning Administrator for all kiosks to be located in areas zoned PO.
(f) The City of Pittsburgh Art Commission must review and make a recommendation to the Zoning Administrator for all kiosks to be located in the public right-of-way.
(g) Promptly upon determining that an application is complete, the Zoning Administrator shall notify all owners of record of property within the affected area (within 50 feet of the proposed kiosk), or to such extended distance to insure that no less than the 10 nearest owners of record are so notified in writing. Property owners receiving notification shall respond to the Zoning Administrator, in writing, whether they oppose or affirm the application within seven days of receipt of the notification from the Zoning Administrator. Failure to respond will imply consent of the subject application. One negative recommendation from a notified property owner will prompt a public hearing before the Planning Commission for a recommendation to the Zoning Administrator on the application.
