Title
Resolution authorizing the City of Pittsburgh to issue a quit claim deed for property, designated as Block 34 D, Lot 20 (part),  in the 18th Ward of the City of Pittsburgh, to the Port Authority of Allegheny County for the specific purpose of re-aligning the Overbrook Transit line and further to authorize a permanent subsurface easement and permanent drainage easements under the same parcel.
 
Body
WHEREAS:   The City of Pittsburgh owns certain property in the 18th Ward, designated as Block 34 D, Lot 20, commonly known as McKinley Park; and
 
WHEREAS:   The Port Authority for the specific purpose of re-aligning the Overbrook Transit line portion requires two portions of real property as well as a permanent subsurface easement and permanent drainage easements under, across and through this City property,
 
WHEREAS:    The City agrees to accept an equal amount of Port Authority property to replace City property required for re-alignment.
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:
 
SECTION 1.      That the proper officers of the City of Pittsburgh are hereby authorized to execute and deliver a Quit Claim deed, in form approved by the City Solicitor, and also a permanent subsurface easement and permanent drainage easements to the Port Authority for the following described properties:
 
-      A linear portion of 34 D, Lot 20, containing 16,072 square feet in a Northern portion and 11,079 square feet in a Southern portion defined on Schedule 'A' in the Agreement.
 
-      A subsurface easement containing 54,652 square feet of area defined on Schedule 'B' in the agreement.
 
-      Two drainage easements with a control portion containing 12,091 square feet and a southeasterly portion containing 1,825 square feet defined in Schedule 'C' in the agreement.
 
 
All the above described properties are as per plan prepared by S. E. Technologies, Inc. for the Port Authority of Allegheny County dated 5-31-00,  revised 8-15-00 and 6-6-01.  Drawing number 980349-100 and cross section SK890 dated 5-31-00.
 
 
SECTION 2.      That said conveyance and easements shall be subject to the following terms and conditions:
 
All state and local transfer taxes shall be paid by the Port Authority of Allegheny County, if any
 
All property closing charges shall be paid by the Port Authority of Allegheny County.
 
The Port Authority of Allegheny County shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent drainage easement.
 
The Port Authority of Allegheny County, its successors and assigns, shall hereby indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages arising by reason of said construction, installation, maintenance or use.
