Title
An Ordinance amending the Pittsburgh Code Title Seven, Business Licensing, Article III, Sales Business, Chapter 719 Vendors and Peddlers, by the addition of Section 719.10, Vending Overlay Districts, specifically adding Section 719.10(a) North Shore Stadiums/Special Events District, setting forth the boundaries, permitted vending locations, restrictions on vending and peddling activities.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.  That the Pittsburgh Code, Title Seven, Business Licensing, Article III, Sales Business, Chapter 719 Vendors and Peddlers, is hereby amended by the addition of Section 719.10, Vending Overlay Districts, specifically adding Section 719.10(a) North Shore Stadiums/Special Events District, as follows:
 
ยง719.10 VENDING OVERLAY DISTRICTS
 
(a)      North Shore Stadiums/Special Events District
 
1)  Vending and Peddling Boundaries
 
The North Shore Stadiums/Special Events Vending Overlay District shall be designated within the following boundaries in accordance with Chapter 719.05A.c:
 
North - State Highway 279 and the Railroad underpass.
South - The Allegheny River   
East - Anderson Street
West - Allegheny Avenue
 
A map detailing the designated area described above shall be available at the Licensing Counter, Bureau of Building Inspection, and provided to any individual applying for a vendor's license, vending location, or peddler's license within the designated area.
 
 
2)      Permitted Vending Sites and Licenses
 
(a)      The total number of Vendor's licenses permitted within this District shall not exceed forty (40).
      
(b)        The following are hereby designated as vending sites for this District:
      
(1)      The four corners at the intersection of Reedsdale Street and Tony Dorsett Street; and
(2)      The four corners at the intersection of Lacock Street and Sandusky Street; and
(3)        The two eastern corners of Sandusky Street at the 7th Street Bridge; and
(4)        The four corners of the intersection of Tony Dorsett Street and West General Robinson Street; and
(5)      The two northern corners of Lacock Street at the Federal Street intersection.    
 
(c)      The designated vending sites, in section 2(b) above, are subject to change by the Street and Sidewalk Vending Site Designation Committee based on the construction of future developments within the District.  Any licensed Vendor, whose vending site is changed due to the construction of future developments, shall be relocated to an approved site within the District.   
 
(d)      The Department of Public Works shall determine the number of vendors per designated vending site, applying the criteria set forth in Section 719.05A, Permitted Locations.
 
(e)      Additional vending sites may be designated in accordance with applicable provisions of Chapter 719.
 
(f)      North Shore Stadiums/Special Events Vendor's Licenses are subject to the Vendor/S&E fee specified in Section 719.08.
 
3)  License Application and Duration
 
(a)      Licenses shall be valid for one (1) calendar year and may be renewed for one (1) additional calendar year prior to expiration upon payment of the applicable fee, provided all the requirements of this Chapter are met.  At the end of the second calendar year, the designated site shall be considered unencumbered and subject to the procedures set forth in Section 719.05B(b).  Nothing in this Section shall prohibit an individual, firm, business, association, corporation or other entity from reapplying for the same location at the end of the second calendar year.    
 
(b)      At the inception of this Overlay District, the names of all prospective permittees, who have complied with the application process, shall be eligible and entered into a lottery held by the Department of Public Works.  All prospective permittees or designated representatives, shall be present at the holding of the lottery and shall be appropriately notified of the site, time and date of the lottery.  Upon selection of a prospective permittees name, the prospective permittee or designated representative, shall have the right to select any of the designated sites available within this District.  
 
(c)      Any designated sites that are available subsequent to the lottery process set forth above in section (b) and where there is more than one (1) prospective applicant seeking to vend at a particular designated site, the procedures set forth in Section 719.05B(b) shall be applicable.   
 
4)  Vending Restrictions
 
Vendors at the designated vending sites within the North Shore Stadiums/Special Events Vending Overlay District shall comply with the following restrictions:
 
(a)      Vending shall only occur five (5) hours prior to, during, and one (1) hour following any scheduled sporting event or other event being held within the area designated in Section 1 above; and
 
(b)      The only items to be sold at the designated vending sites shall be food products, non-alcoholic beverages and sports and event-related merchandise, which does not include the sale of tickets; and
 
(c)      Any individual, firm, business, association, corporation or other entity shall be limited to one (1) vendor's license within this District.  
 
(d)      Vendors shall be in full compliance with all provisions of Chapter 719, Vendors and Peddlers, which are not specifically addressed by this Section.
 
5)      Peddling, Stationary Vehicular Vending and Mobile Vehicular Vending Restrictions
 
(a)      Peddling, Stationary Vehicular Vending and Mobile Vehicular Vending as defined in Section 719 shall be prohibited within this District.
