Resolution Vacating a portion of Harcol Way in the 5th Ward, 7th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Harcol Way in the 5th Ward, 7th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  That vacating a portion of Harcol Way, 20' feet wide at Lisbon Stree; Beginning at a point on the north east corner of Lisbon Street, 50' wide at the intersection of Harcol Way, 20' feet wide, thence eastwardly N 51º 45' 00" E a distance of 91.29' feet to a point, adjacent to Lots 32, 31, 30 and 29 in the Thomas McNeil Plan of Lots; thence southerly S 38º 15' 00" E a distance of 10.00' feet to a point; thence westerly S 51º 45' W a distance of 30.50' feet to a point; thence southerly S 33 44' 00" E a distance of 10.03 feet to a point; thence westerly S 51º 45' W a distance of 60.00' feet to a point, adjacent to lots 56, 57, and 58 in the Thomas McNeil Plan of Lots; thence N 38º 15' W a distance of 20.00' feet to the place of beginning, adjacent to Lot and Block Parcels 26-L-313 and 26-L-293, containing 1517 square feet.

PWSA will not maintain a dead end sewer system on private property.  This vacation requires construction of new end manhole located in Harcol Way; 15" combination sewer becoming private and responsibility of each abutting property owner as permitted by the Allegheny County Health Department.  Property owner must build manhole at his own cost and expense at terminus of public right-of-way of Harcol Way, be responsible for manhole and have PWSA review and approve plans, in the 5th Ward, 7th Council District of the City of Pittsburgh as described below shall be and the same is hereby vacated.
