Resolution authorizing the Mayor and the Director of the Department of Finance to execute a quit claim deed or deeds, and any other necessary or appropriate documents, agreements, and instruments conveying AS IS all of the City’s right, title and interest, if any, in a specified portion of the vacated Union Avenue, comprising the access drive for the Allegheny Commons Apartments and ancillary open space to Allegheny Commons Community Partnership LP for consideration of $1.00.

Whereas, pursuant to Ordinance 212 of 1971 the City vacated the portion of Union Avenue adjacent to the Allegheny Commons Apartments located at 225 E Ohio Blvd in the 22nd Ward of the City of Pittsburgh; and

 

Whereas, pursuant to Ordinance 362 of 1972, the City granted a license to developers of the Allegheny Commons Apartments allowing for the use of the City’s portion of the vacated Union Avenue as an access driveway for the residents; and

 

Whereas, the owners of the Allegheny Commons Apartments have operated and maintained the driveway and ancillary greenspace on the former Union Avenue since 1972; and

 

Whereas, the City now wishes to convey all of its interest in the specified portion of the former Union to Allegheny Commons Community Partnership so as to clarify maintenance and security responsibilities.

 

Be it resolved that the Council of the City of Pittsburgh does hereby enact as follows:

 

Section 1.                     The Mayor and the Director of the Department of Finance  of the City of Pittsburgh are authorized to execute a quit claim deed or deeds, and any other necessary or appropriate documents, agreements, and instruments conveying to Allegheny Commons Community Partnership LP for consideration of $1.00 AS IS all of the City’s right, title and interest, if any,  in the portion of the vacated Union Avenue depicted in the attached EXHIBIT A and described as follows:

 

BEGINNING at a cross cut found on the southerly sideline of East Ohio Street (80’ wide R.O.W.) said point being North 76 degrees 02 minutes 50 seconds East, a distance of 205.25 feet from the northerly terminus of a 25’ curve connecting the same with the easterly sideline of East Commons (70’ wide R.O.W.), and from said BEGINNING point running; thence

 

1.                     Along said southerly sideline of East Ohio Street, North 76 degrees 02 minutes 50 seconds East, a distance of 42.05 feet to a point; thence

 

Through the vacated portion of Union Avenue (vacated per Ord. 212), the following six (6) courses and distances:

 

2.                     South 05 degrees 48 minutes 47 seconds East, a distance of 1.54 feet to a point of curvature, thence;

 

3.                     Along a curve to the right, non-tangent to the prior course, having a radius of 48.44 feet, a central angle of 25 degrees 44 minutes 36 seconds West, an arc length of 21.76 feet, a chord bearing of South 07 degrees 03 minutes 31 seconds West, and a chord distance of 21.58 feet to a point, thence;

 

4.                     South 14 minutes 07 seconds 27 seconds East, a distance of 488.67 feet to a point, thence;

 

5.                     North 76 degrees 00 minutes 08 seconds East, a distance of 7.84 feet to a point, thence;

 

6.                     South 13 degrees 59 minutes 52 seconds East, a distance of 82.00 feet to a point; thence

 

7.                     South 76 degrees 04 minutes 13 seconds West, a distance of 43.00 feet to an iron bar with cap found on the division line between Lot 20-1 Block 8-B, and Lot 50 Block 8-D; thence

 

8.                     Along the same, North 13 degrees 59 minutes 52 seconds West, a distance of 592.30 feet to the point and place of BEGINNING.

 

Containing 0.489 acres (21,289 square feet) of land more or less.

 

Section 2.                     All deed or deeds, and any other necessary or appropriate documents, agreements, and instruments shall be in a form approved by the City Solicitor.
