Resolution vacating a portion of Rutherford Avenue between Wentworth Avenue and Crane Avenue in the 19th Ward, 4th Council District of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Rutherford Avenue in the 19th Ward, 4th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and
Whereas, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
That vacating a portion of Rutherford Avenue between Wentworth Avenue and Crane Avenue, beginning at a point at the northwesterly corner of Wentworth Avenue, 50' wide, and Rutherford Avenue, 50's wide, as shown on the West Liberty Plan of Lots No. 5, recorded in Plan Book Volume 21, pages 132-133; thence along Rutherford Avenue, North 1°18' East, a distance of 215.00 feet to a point on the line of Rutherford Avenue previously vacated by Ordinance No. 479 of 1958; thence along said vacation line, North 54°25'50" East a distance of 24.97 feet to a point; thence continuing along said vacation line, North 1°18' East, a distance of 95.21 feet to a point on the southerly line of Crane Avenue, thence along Crane Avenue by the arc of a circle curving to the right, having a radius of 200.00 feet, and an arc length of 10.05 feet to a point on the line of Rutherford Avenue previously vacated by Ordinance No. 479, aforementioned; thence continuing along the line of said Ordinance the following four courses and distances: First: South 1°18' West, a distance of 99.24 feet to a point; Second: South 70°15'50" East, a distance of 36.89 feet to a point, Third: South 1°18' West, a distance of 35.00 feet to a point; Fourth: North 88°42' West, a distance of 15.00 feet to a point on the easterly line of Rutherford Avenue as shown on the West Liberty Plan of Lots No. 5; thence along said line, South 1°18' West, a distance of 180.00 feet to a point on the Northerly line of Wentworth Avenue, 50' wide; thence along the line of Wentworth Avenue, North 88°42' West, a distance of 50.00 feet to a point at the place of beginning of this description, in the 19th Ward, 4th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
