Resolution authorizing the City of Pittsburgh to grant to Duquesne Light Company permanent utility easement for the installation, use, operation, maintenance, repair, renewal and for the removal of an underground electrical transmission line across City of Pittsburgh property designated as Block 82-H, Lot No. 1 located along Washington Boulevard between the Leech Farm Road intersection and Negley Run Boulevard in the 11th and 12th Wards of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor, the Director of the Department of Finance and the Director of the Department of Public Works on behalf of the City of Pittsburgh are hereby authorized to execute an agreement with Duquesne Light Company for a permanent easement across City of Pittsburgh property Block 82-H, Lot No. 1 in the 11th and 12th Wards.  Said agreement shall be in form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh and Highland Park as said Solicitor may require.
 
Description of Utility Easement:
This underground utility easement is shown on Duquesne Light Company Construction Drawings 18002-T40 to 18002-T44 which show the detail of the proposed easement along Washington Boulevard.  Also attachment 'A' to this Ordinance is the legal description for this permanent easement for the Arsenal-Highland 138 & 345KV Lines.
 
Section 2.      The privilege and easement hereby granted shall be subject to the following terms and conditions as shall be more specifically set forth in the agreement authorized by this Resolution:
a)      Duquesne Light Company shall bear the full cost and expense of the installation, construction, use and maintenance of said permanent utility easement and temporary construction easement.
b)      Duquesne Light Company shall hereby indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages arising by reason of said construction, installation, maintenance or us of such line.
c)      Duquesne Light Company shall cause minimum disruption to the natural environment of the Park along this frontage of Washington Boulevard bordering on Highland Park.
d)      Duquesne Light Company shall restore the easement area in cooperation with and in accordance with the requirements of the Director of Public Works or his designate for this section of Highland Park frontage and Fire Chief for the adjacent Public Safety Training Academy and its affected parking lot area.
e)      Duquesne Light Company shall pay to the City of Pittsburgh $1,000.00 (One Thousand Dollars), a one-time fee for this permanent utility easement, due on the date of the signing of this agreement.

Permanent Easement

Arsenal - Highland 138 & 345 kV Lines
 
 
      All that certain parcel of ground situate in the 11th and 12th Wards, City of Pittsburgh, Allegheny County, Commonwealth of Pennsylvania, designated as a Permanent Easement for Arsenal - Highland 138 & 345 kV Lines, being more particularly bounded and described as follows:
 
      Beginning at a point on the westerly right-of-way of Washington Boulevard, said point located N 84°47'00" W and a distance of 75.09 feet and S 05°13'00" W a distance of 117.12 feet from a monument identified as "DCP Mon 5111" found near the centerline of Leech Farm Road and near the easterly edge of Washington Boulevard on the sheet 14 of 31 PennDOT Construction Plans, for the widening of Washington Boulevard; thence from said point of beginning along said right-of-way line of Washington Boulevard S 05°13'00" W a distance of 1048.77 feet to a point; thence through lands now or formerly of City of Pittsburgh Highland Park S 42°06'43′ W a distance of 269.26 feet, more or less, to a point on the easterly right-of-way line of Hill Street; thence along the said easterly right-of-way line N 12°37'26" W a distance of 24.49 feet to a point; thence through lands now or formerly of City of Pittsburgh Highland Park for the following four courses:  (1.)  N 42°06'43" E a distance of 176.76 feet, more or less, to a point; (2.)  N 23°39'51" E a distance of 88.60 feet to a point; (3.)  N 05°13'00" E a distance of 1015.37 feet to a point; (4.)  S 84°47'00" E a distance of 35.00 to the point of beginning.
 
Containing 42,521.45 square feet or 0.976 acres.
