Title
Resolution authorizing the City of Pittsburgh ("City") to Petition the Court of Common Pleas of Allegheny County to sell a certain lot ("Property"), now part of Highland Park, to Michael Gallagher and Angela Scolieri Gallagher, his wife ("Buyers"), for the sum of Fifteen Thousand Dollars ($15,000.00), or upon such other terms and conditions as the Court may authorize and/or direct.
 
Body
WHEREAS, the Property was acquired by the City at Treasurer's Sale No. 234 on June 7, 1948, said Property then being designated as Block and Lot No. 82-B-125; and
 
WHEREAS, pursuant to Resolution No. 386, of 1984, the Property, then designated as Block and Lot No. 121-P-200, with an address of 1605 Heths Avenue, was by said Resolution of this Council, made an addition to Highland Park; and
 
WHEREAS, pursuant to Resolution No. 689 of 2007, this Council authorized sale of the Property to the Buyers for the sum of Fifteen Thousand Dollars ($15,000.00), and
 
WHEREAS, during the course of preparing the documents necessary to process the sale to Buyers pursuant to Resolution No. 689 of 2007, the Law Department learned that this Council was not aware of Resolution No. 386 of 1984, which made the Property part of Highland Park; and
 
WHEREAS, this Council, after reasonable inspection and investigation, has determined that the Property is a lot fronting on Villanova Road, between houses owned by Mrs. Gallagher's parents and sister, that Villanova Road is a cul-de-sac consisting entirely of single family homes, except for the Property, and that the Property to the rear is bordered by a precipitous slope, which slope is part of Highland Park, but, which slope renders the Property unusable for Park purposes
 
Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
 
Section 1.  The City Solicitor is hereby authorized to Petition the Court of Common Pleas to authorize the sale of that certain Property formerly known as Block and Lot No. 121-P-200 to Michael Gallagher and Angela Scolieri Gallagher, his wife, for the sum of Fifteen Thousand Dollars ($15,000.00), and upon such other terms and conditions as the Court may authorize and/or direct.
