Resolution vacating a portion of Calvin Street between 44th and 45th Streets and a portion of Keller Way from 44th Street to its easterly terminus in the 9th Ward, 7th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Calvin Street and Keller Way in the 9th Ward, 7th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by ant persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That vacating a portion of Calvin Street; All that certain street, being a portion of Calvin Street, to be vacated, situate in the 9th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the southerly right of way line of Calvin Street, 40.00 feet wide, and the easterly right of way line of 44th Street, 40.00 feet wide; thence from said point of beginning by the easterly right of way line of 44th Street N 11° 30' 00" W a distance of 40.00 feet to a point on the northerly right of way line of Calvin Street; thence by the northerly right of way line of Calvin Street N 78° 25' 30" E a distance of 342.41 feet to a point on the westerly right of way line of 45th Street, 50.00 feet wide; thence by the westerly right of way line of 45th Street S 11° 38' 30" E a distance of 40.00 feet to a point on the southerly right of way line of said Calvin Street; thence by the southerly right of way line of said Calvin Street S 78° 25' 30" W a distance of 342.51 feet to a point at the intersection of the southerly right of way line of said Calvin Street and the easterly right of way line of said 44th Street, at the point of beginning.
All that certain street, being a portion of Keller Way, to be vacated, situate in the 9th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the southerly right of way line of Keller Way, 15.00 feet wide, and the easterly right of way line of 44th Street, 40.00 feet wide; thence from said point of beginning by the easterly right of way line of 44th Street N 11° 34' 00" W a distance of 15.00 feet to a point on the northerly right of way line of Keller Way; thence by the northerly right of way line of Keller Way N 78° 25' 30" E a distance of 99.72 feet to a point on the easterly terminus of existing Kelley Way and the westerly terminus of a portion of former Keller way as vacated by City of Pittsburgh resolution 18, approved January 24, 1957; thence by the easterly terminus of existing Keller Way S 11° 34' 00" E a distance of 15.00 feet to a point on the southerly right of way line of Keller Way; thence by the southerly right of way line of Keller Way S 78° 25' 30" W a distance of 99.72 feet to a point at the intersection of the southerly right of way line of Keller Way and the easterly right of way line of said 44th Street, at the point of beginning.
An 8" waterline in Calvin Street can be abandoned within the area of the proposed vacation.
A 12" sewerline in Calvin Street between 44th & 45th Street can be abandoned and a 15" sewerline in Calvin Street between 44th & 45th Street can be abandoned contingent upon the following:
The 15" sewerline in 45th Street between Calvin Street & Garden way will need to be abandoned and remain private. Currently, PWSA will not accept a portion of any new public sewer system draining into a privately owned existing sewer system.
PWSA/City will be compelled to reserve the right to use this existing abandoned private sewer system in 45th Street to drain the surrounding area and public roadway and facilities, in the 9th Ward, 7th Council District of the City of Pittsburgh as described shall be and the same is hereby vacated.
