Resolution vacating a portion of Shakespeare Street and Houston Street in the 7th, Ward, 8th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Shakespeare Street and Houston Street  in the 7th Ward, 8th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation.
 
Be it resoled by the Council of the City of Pittsburgh as follows:
 
Section 1.  That All certain section of Shakespeare Street and Houston Street, situate in the 7th Ward, City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, more particularly bounded and described as follows:
 
Beginning at a point on the southerly right of way line of Penn Circle South, (formerly Centre Avenue), 60' wide, said point also being a northeasterly corner of property of now or formerly Citizens Bank of Pennsylvania; thence along the southerly right of way line of Penn Circle South, (formerly Centre Avenue), 60' wide, North 68º 39'00.7" East 65.00' to a point at the northwesterly corner of property of now or formerly Eastside Limited Partnership III;  thence along he Westerly line of property of now or formerly Eastside Limited Partnership, III, South 21º20'59.3" East, 135.21' to a point on a northeasterly corner of property of now or formerly Eastside Limited Partnership, III; thence along the northerly line of property of now or formerly East side Limited Partnership, III, South 68º39'00.7" West, 138.56' to a point on the southerly right of way line of Houston Street, 40' wide; thence through the right of way of Houston Street, 40' wide, North 19º58'18.9" West, 40.01' to a point on the northerly line of Houston Street, 40' wide, and on the Southerly line of  now or formerly Eastside Limited Partnership, III; thence the Southerly line of property of now or formerly Eastside Limited Partnership and along the Southerly and Easterly lines of property of now or formerly Citizens Bank of Pennsylvania, The Northerly right of way line of Houston Street, 40' wide and the westerly right of way line of Shakespeare Street, 40' wide, the following  four (4) courses and distances, viz: North 68º39'00.7" East, 72.60' to a point: thence by an arc of a circle deflecting to the left in a northeastwardly direction, having a radius of 25.00', an arc distance of 39.27' (chord bearing and distance, North 23º39'00.7" East, 35.36) to a point; thence North 21º20'59.3" West, 45.21' to a point; thence by an arc of a circle deflecting to the left in a northwestwardly direction, having a radius of 25.00', an arc distance of 39.27' (chord bearing and distance, North 66º20'59.3" West, 35.36') to a point at the place of beginning.
 
Containing 9,600 Sq. Ft. or 0.220 Acres
 
1.      The existing waterline in the proposed vacated area can be abandoned if the abutting properties are to be demolished and/or removed.  The said 8" waterline in Shakespeare Street and 8" reduced to 6" waterline in Houston Street can be abandoned if a Tap Termination Plan is filed according to PWSA current regulation.  The existing Tees, Vales , Fire Hydrant and Appurtenances must also be removed and/or relocated as per current PWSA Regulations and Construction Standards.
 
2.      The Sewer Mapping indicates that there is a 15' sewer line in Houston Street within the area of the proposed vacation.  The existing sewerline in the proposed vacated area can be abandoned if the abutting properties are to be demolished and/or removed.  The said 15' sewerline in Houston Street can be abandoned if a Tap Termination Plan is filed according to PWSA current regulations.  The existing Manhole and Appurtenances must also be removed as per current PWSA Regulation and Construction Standards.
